A Resolution Approving Emergency Engine Repairs to a Fire Pumper in Excess of Bid Law Amounts
Summary
We currently have three of our fire pumpers out of service due to mechanical and electrical issues. Two of these are reserve pumpers, and work is underway on one of them. We have no reserve units left, and we currently don't have a pumper available for response out of Fire St. 2. The third is a frontline unit, and it is in a repair facility in Mobile with engine issues that require a complete rebuild. The amount of the repairs is estimated at $38,103.35 which exceeds the amount that is exempt from the bid law. We have already ordered some of the parts required for the repair directly from Sunbelt Fire at a cost of $11,481.43. Therefore, the total cost of the repair is estimated at $49,584.78. We have received a legal opinion that allows the Council to declare this an emergency purchase under guidelines for which a delay would likely cause harm to an individual or public property as specified in Section 41-16-53 of the Code of Alabama.

WHEREAS, The Foley Fire Department has three of its fire pumpers out of service due to mechanical issues and has no reserve apparatus available and no pumper available to respond out of Fire St. 2, and
WHEREAS, two price estimates have been obtained for repairs and the lower amount estimated for repairs to a frontline pumper is $38,103.35 which exceeds the amount exempted under the bid law and some of the repair parts have been purchased directly through Sunbelt Fire for $11,481.43, and
WHEREAS, the Code of Alabama in Section 41-16-53 allows the Council to let a contract in the event circumstances arise for which a delay would likely cause harm to an individual or public property.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Declares the repairs necessary, without further delay, to prevent harm and fire loss to the community and approves the repairs as quoted in the amount of $38,103.35 by Cummins Sales and Service in Mobile for a total repair cost of $49,584.78.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
