The contractor has taken measures to the best of their ability and plans to address cross traffic issues along the congested area near the intersection of Highway 59 and CR20 (Miflin Road), which is in close proximity to Chick Fil A; however, they are having safety concerns with traffic.      WHEREAS,  Resolution 25-1475 awarded the bid to L & K Construction LLC for the Miflin Road Access Management Plan Phase 1, and

 

     WHEREAS,  the contractor has taken measures to the best of their ability and plans to address cross traffic issues along the congested area near the intersection of Highway 59 and CR20 (Miflin Road), which is in close proximity to Chick Fil A; however, they are having safety concerns with traffic, and

 

     WHEREAS,  Foley Police Department's close patrols have assisted and it has been determined there is a need for an off-duty officer stationed on-site in order to safely proceed with the project, and

 

     WHEREAS,  L & K Construction is requesting a $2,000 Change Order for an off-duty officer stationed on-side for safety concerns, and

 

     WHEREAS,  Engineering is requesting to memorialize the funding to cover Change Order #1 for an off-duty officer stationed on-site.

 

     NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:

 

     SECTION 1:     Approve and appropriate additional funds in the amount of $2,000.00 and Memorialize L & K Construction's Change Order #1 request and for the Miflin Road Access Management Plan Phase 1 under Account No# 400-3020-5148.

 

     SECTION 2:     This Resolution shall become effective immediately upon its adoption as required by law.
