Body

     WHEREAS, in accordance with the Intergovernmental Service Agreement between the Baldwin County Commission and the City of Foley dated September 17, 2013 and Addendum dated October 7, 2014, the city is to assume maintenance for the ATRIP CR 20 Widening and Resurfacing project, and

 

     WHEREAS, this portion of CR 20 from South Hickory Street to AL 59 has been inspected by the Engineering Department and finds that the infrastructure was in good condition.

 

BE IT ORDAINED that the Foley City Council as follows:

 

     Section 1.     The City of Foley hereby accepts all public rights of way and infrastructure improvements of CR 20 between South Hickory Street and AL 59.

    

     Section 2.     ”The terms and provisions of this ordinance are severable.  If any part or portion of this ordinance is declared invalid, void, or unconstitutional, that portion shall be deemed severed, and the remaining portions of the ordinance shall remain in full force and effect."

 

     Section 3.     All ordinances or parts of ordinances, in any manner conflicting herewith are hereby repealed.

 

     Section 4.     This ordinance shall become effective upon its publication as required by law.
