ORDINANCE AMENDING ORDINANCE NO. 387-87 FOR THE INITIAL ZONING OF PROPERTY OWNED BY FLOWERS 8 LLC TO B1A - EXTENDED BUSINESS DISTRICT

 

                     WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a new Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and

 

                     WHEREAS, the Planning Commission has recommended approval of this initial zoning, and

                     WHEREAS, the City of Foley has received a request that specific property within the City be initially zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and

                     WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met,

                     NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA while in regular session accepted the following changes:

Section 1.                     That the official Zoning Map of the City of Foley, Alabama be amended to initially zone the property to B1A - Extended Business District said property description as follows:

 

LEGAL DESCRIPTION PER TITLE COMMITMENT:

 

A parcel of land situated and being located in the Northeast Quarter of the Northeast Quarter (NE 1/4 of the NE 1/4) of Section 17, Township 8 South, Range 4 East, Baldwin County, Alabama, and being more particularly described as follows, to-wit:

BEGINNING at a 3/4-inch iron rod at the Northeast corner of the Northeast Quarter of the Northeast Quarter (NE 1/4 of the NE 1/4) of Section 17, Township 8 South, Range 4 East, Baldwin County, Alabama, said point also being at the intersection of the westerly margin of Alabama State Highway No. 59 with the southerly margin of Baldwin County Highway No. 12; thence run from said POINT OF BEGINNING South 00 degrees 00 minutes 00 seconds East along the westerly margin of Alabama State Highway No. 59 a distance of 400.00 feet to a 1/2-inch iron rod; thence departing the westerly margin of Alabama State Highway No. 59 run North 90 degrees 00 minutes 00 seconds West a distance of 330.00 feet to a 1/2-inch iron rod; thence run North 00 degrees 00 minutes 00 seconds East a distance of 400.00 feet to a 1/2-inch iron rod on the southerly margin of Baldwin County Highway No. 12; thence run North 90 degrees 00 minutes 00 seconds East along the southerly margin of Baldwin County Highway No. 12 a distance of 330.00 feet to the POINT OF BEGINNING.

 

SECTION 2: That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.

 

SECTION 3:  This Ordinance shall become effective immediately upon its adoption as required by law.
