(Second Reading) AN ORDINANCE AMENDING ORDINANCE 18-2018  AN ORDINANCE PERMITTING AND REGULATING THE OPERATION OF APPROVED GOLF CARTS AND LICENSED LOW SPEED VEHICLES ON CERTAIN PUBLIC STREETS WITHIN THE CITY OF FOLEY UNDER CERTAIN RULES AND REGULATIONS

Body

WHEREAS, the City of Foley adopted Ordinance 18-2018, which has since been codified as Section 15-22 in the Foley Code of Ordinances, pertaining to low speed vehicle operations in the City of Foley; and

WHEREAS, the state law that allowed for low speed vehicle operations has since been amended to allow “State Tagged Carts” on designated streets that are 35 mph or less; and

WHEREAS, the City of Foley desires to amend its local ordinance pertaining to low speed vehicles to be consistent with the current state law on this subject;

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA as follows:

 

Section 1.   That Ordinance 18-2018, codified as Section 15-22 in the Foley Code of Ordinances, is hereby amended to revise the second sentence in subsection (c) (“Rules and Regulations”) to read as follows:

 

"A State Tagged cart that is not a Municipal Service Vehicle may not be operated on any public street, road, or highway within the corporate limits of the City of Foley on which the posted legal speed limit is greater than 35 miles per hour."

 

Section 2.  That all other provisions of Ordinance 18-2018, codified as Section 15-22 in the Foley Code of Ordinances, not expressly amended above, or amended previously by Ordinance, remain in full force and effect.

 

Section 3.  That the provisions of this Ordinance are servable.  If any part of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, such declaration shall not affect the validity and enforceability of the remaining provisions of the Ordinance.

 

Section 4.  That this ordinance shall become effective upon its adoption and publication as required by law.
