WHEREAS, Riviera Square has obtained three land swap agreements with property owners so that there is adequate right of way necessary to construct a new public road across from the Tanger Outlets’ entrance (“New Road”), and
WHEREAS, this New Road may, as part of the City’s master plan, in the future serve as a connector between Highway 59 and Pine Street, and
WHEREAS, Riviera Square has agreed to give portions of its land to certain land owners and make improvements thereon in order for them to be willing to convey portions of their property so that the City might have this New Road, and
WHEREAS, the New Road will also allow ALDOT to close the current entrance to Jade Garden restaurant which does not meet traffic signal spacing requirements under ALDOT standards, and
WHEREAS, Riviera Square needs certain wayfinding signage within the New Road right of way and the City desires to grant this signage for the safety of the City’s citizens and visitors along Highway 59. Without this wayfinding signage, many citizens and tourist would take a U-turn along Highway 59 to enter these retail developments because they will have missed their turn. By placing signage at a lighted intersection, travelers will be able to see the occupants of the Foley Square and Riviera Square developments in a timely fashion, and
WHEREAS, to further the community partnership between Riviera Square and the City, Riviera Square will allow the City to have either a panel on the sign or, if a digital media board is installed, a rotation in the digital screen display so that the City can advertise events or other matters of its choosing, and
WHEREAS, Riviera Square’s acquisition of the additional right of way needed and construction of the New Road is a benefit to the City, the City is agreeable to the placement of the directional wayfinding signage within the right of way of this New Road in the approximate location shown on the Exhibit A, and
WHEREAS, per the drawing submitted, the sign is 35’ tall with a base width of 15’2” with defined areas for signage (“Sign”).
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Approves the placement of the Sign within the right of way of the New Road to be built opposite the Tanger Outlets’ entrance and dedicated to the City.
SECTION 2: Approves the Engineering Department to work with Burton Properties to ensure the sign to display City of Foley events, possible weather events, amber alerts and other uses for public purposes.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
