ORDINANCE AMENDING ORDINANCE NO. 387-87 REZONING PROPERTY OWNED BY Smart Living LLC FROM PUD Four-Plex TO PUD Single Family

 

Body

WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and

 

WHEREAS, the City of Foley has received a request that specific property within the City be re-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and

 

WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, while in regular session on July 6, 2015 as follows:

 

Section 1.                     That the official Zoning Map of the City of Foley, Alabama be amended to rezone the portion of property previously zoned PUD Four-Plex to PUD, Planned Unit Development Single Family; said property description as follows:

 

Tax Map No. 05-61-04-20-4-001-001.007, PIN No. 341559

 

COMMENCE AT THE RECORD LOCATION OF THE NORTHEAST CORNER OF THE SOUTHEAST QUARTER OF SECTION 20, TOWNSHIP 8 SOUTH, RANGE 4 EAST, BALDWIN COUNTY, ALABAMA AND RUN THENCE NORTH 89 DEGREES 24 MINUTES 58 SECONDS WEST, A DISTANCE OF 666.30 FEET TO A POINT; THENCE RUN SOUTH 00 DEGREES 03 MINUTES 14 SECONDS EAST, A DISTANCE OF 40.00 FEET TO A CONCRETE MONUMENT ON THE SOUTH RIGHT-OF-WAY OF BALDWIN COUNTY HIGHWAY 10; THENCE RUN NORTH 89 DEGREES 24 MINUTES 38 SECONDS WEST, ALONG THE NORTH RIGHT-OF-WAY OF SAID BALDWIN COUNTY HIGHWAY 10, A DISTANCE OF 746.79 FEET TO A CAPPED REBAR (CA-0951-LS) FOR A POINT OF BEGINNING: CONTINUE THENCE NORTH 89 DEGREES 24 MINUTES 38 SECONDS WEST, ALONG SAID RIGHT-OF-WAY, A DISTANCE OF 1267.97 FEET TO A CAPPED REBAR (LS #14568); THENCE RUN SOUTH 00 DEGREES 32 MINUTES 56 SECONDS WEST, A DISTANCE OF 1306.84 FEET TO A CAPPED REBAR (LS #4563); THENCE RUN SOUTH 89 DEGREES 53 MINUTES 50 SECONDS EAST, A DISTANCE OF 1274.40 FEET TO A CAPPED REBAR (CA-0951-LS); THENCE RUN NORTH 00 DEGREES 15 MINUTES 58 SECONDS EAST, A DISTANCE OF 1296.04 FEET TO THE POINT OF BEGINNING. TRACT CONTAINS 37.98 ACRES, MORE OR LESS, AND LIES IN THE SOUTHEAST QUARTER OF SECTION 20, TOWNSHIP 8 SOUTH, RANGE 4 EAST, BALDWIN COUNTY, ALABAMA.

 

SECTION 2.                     That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.

 

SECTION 3:                      This Ordinance shall become effective immediately upon its adoption as required by law.
