A Resolution Setting A Public Hearing For An Ordinance To Amend Ordinance No. 24-2006, The Floodplain Development Ordinance, And Re-Title It As The FEMA-Recognized Flood Damage Prevention Ordinance

WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 24-2006, pertaining to Floodplain Development; and
WHEREAS, the City of Foley maintains flood damage prevention regulations to regulate development within identified flood hazard areas and to support the City's continued participation in the National Flood Insurance Program (NFIP) and Community Rating System (CRS); and
WHEREAS, the City proposes to amend Ordinance No. 24-2006 and re-title the ordinance as the FEMA-Recognized Flood Damage Prevention Ordinance, together with the adoption of updated flood damage prevention regulations as presented in the proposed ordinance; and
WHEREAS, the proposed ordinance contains provisions relating to floodplain administration, development permits, flood hazard reduction, enforcement, appeals, variances, and other matters pertaining to flood damage prevention within the City of Foley; and
WHEREAS, the City Council desires to provide an opportunity for interested members of the public to review the proposed ordinance and present comments concerning the proposed amendments prior to consideration of final adoption.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: A public hearing is hereby scheduled for November 2, 2026, at 4:00 p.m., or as soon thereafter as the matter may be heard, during the regular meeting of the City Council of the City of Foley, Alabama, for the purpose of receiving public comments regarding the proposed ordinance to amend Ordinance No. 24-2006, the Floodplain Development Ordinance, and re-title it as the FEMA-Recognized Flood Damage Prevention Ordinance.
SECTION 2: The proposed ordinance and accompanying Flood Damage Prevention Ordinance shall be made available for public inspection prior to the public hearing in accordance with applicable law and City procedures.
SECTION 3: The City Clerk is hereby authorized and directed to provide notice of the public hearing in accordance with applicable law and to take such other actions as may be necessary to properly advertise and conduct the public hearing.
SECTION 4: At the public hearing, all interested persons shall be given an opportunity to be heard concerning the proposed ordinance.
SECTION 5: This Resolution shall become effective immediately upon its adoption.
