WHEREAS, Appendix D of the City of Foley Technical Design Manual establishes a Board of Appeals for the purpose of hearing applications for modification of the requirements of the Technical Design Manual and appeals from decisions of the Department; and
WHEREAS, Section D103 of Appendix D provides that the Board shall consist of five voting members appointed by the chief appointing authority of the jurisdiction, with members serving five-year terms or until their successors have been appointed, and with terms staggered to provide continuity; and
WHEREAS, Section D103.1 provides that members of the Board shall be qualified by experience and training to consider matters pertaining to civil engineering, stormwater, environmental protection, public utilities, or transportation; and
WHEREAS, the City Council finds that the individuals appointed herein possess professional experience, training, and responsibilities relevant to the matters that may come before the Technical Design Board of Appeals; and
WHEREAS, the City desires to formally constitute the Technical Design Board of Appeals in accordance with Appendix D of the Technical Design Manual.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: APPOINTMENT OF VOTING MEMBERS
Pursuant to Section D103 of the Technical Design Manual, the following individuals are hereby appointed as the five voting members of the City of Foley Technical Design Board of Appeals:
1. Darrell Russell, Public Works Director;
2. Buford King, Director of Capital Projects;
3. Nelson Bauer, Infrastructure and Development Program Manager
4. Cian Harrison, Executive Director of General Government; and
5. Thurston Bullock, Executive Director of Public Safety.
The members appointed herein are determined to possess experience and training appropriate to the matters within the jurisdiction of the Board as contemplated by Section D103.1 of the Technical Design Manual.
SECTION 2: TERMS OF APPOINTMENT
In accordance with Section D103, members shall ultimately serve five-year terms or until their successors have been appointed. To establish the staggered terms required by Appendix D and provide continuity of membership, the initial appointments shall be as follows:
Darrell Russell - initial term of one (1) year;
Buford King - initial term of two (2) years;
Thurston Bullock - initial term of three (3) years;
Cian Harrison - initial term of four (4) years; and
Nelson Bauer - initial term of five (5) years.
Following expiration of these initial staggered terms, subsequent appointments shall be for five-year terms in accordance with Section D103.
Vacancies occurring before the expiration of a term shall be filled for the remainder of the unexpired term in accordance with Section D103.2.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
