The Utilities Board of the City of Foley, doing business as Riviera Utilities, will provide domestic water, sanitary sewer, electrical, and natural gas services to the new Safe Room. Various utilities easements will be required to allow Riviera Utilities staff, equipment, and infrastructure to traverse City of Foley property in order to provide the various utility services to the new Safe Room. The Staff of the City of Foley recommends to Council to grant various utility easements to Riviera Utilities and further requests the City Council authorizes Mayor, Clerk, and other City officials to sign the necessary utility easements. Funds for the Safe Room project were appropriated under 25-1473 RES.

WHEREAS, the new City of Foley First Responder's Safe Room (facility), currently under construction, will be complete in mid-2027; and
WHEREAS, the Utilities Board of the City of Foley (Riviera Utilities) will provide, water, sewer, natural gas, and electrical services to the new facility; and
WHEREAS, Riviera Utilities will install various equipment onto City of Foley (City) property, including electrical transformers, pipes, meters, conduit, and various pieces of equipment and infrastructure necessary to provide utility services for the new facility; and
WHEREAS, the staff of The City of Foley recommends to Council to authorize various utility easements in favor of Riviera Utilities to allow equipment and infrastructure to be furnished and installed by Riviera Utilities, or a combination of equipment and infrastructure furnished by the City of Foley and installed by Riviera Utilities to be placed on, under, and above City of Foley property; and
WHEREAS, the staff of The City of Foley requests Council to authorize Mayor, Clerk, and other City officials to sign the various utility easement documents required to proceed with utility installation.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: City of Foley recommends to Council to grant Riviera Utilities various utilIty easements needed to supply utility services for the First Responder's Safe Room currently under construction on North Poplar Street.
SECTION 2: Council authorizes Mayor, Clerk and other City officials to sign the various easement documents required to proceed with utility installation.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
