DESCRIPTION OF TOPIC: This ordinance amends City of Foley Ordinance No. 387-87 by rezoning property owned by the City of Foley from B-1A (Extended Business) and R-3 (Residential Single Family) to PID (Planned Industrial). The rezoning applies to one, +/- 121-acre parcel located at the southeast corner of North Juniper Street and the Foley Beach Express in Baldwin County, Alabama. The Foley Planning Commission recommended approval, and the City Council determined the change supports the health, safety, and general welfare of the community. WHEREAS, the Planning Commission has recommended approval of this rezoning, and
WHEREAS, the City of Foley has received a request that specific property within the City be re-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the heath, safety, morals and general welfare of the City to amend said Ordinance, and
WHEREAS, all requirements to the laws of teh State of Alabama, with regard to the preparation of the report of the FOley Planning Commission and subsequent action of the City Council have been met,
BE IT ORDAINED that the Foley City Council, while in regular session, accepted the changes as follows:
Section 1: That the official Zoning Map of the City of Foley, Alabama, be amended to rezone the property previously zoned as B-1A - Extended Business and R-3 - Residential Single Family to PID - Planned Industrial said property description as follows:

Section 2: "The terms and provisions of this ordinance are severable. If any part or portion of this ordinance is declared invalid, void, or unconstitutional, that portion shall be deemed severed, and the remaining portions of the ordinance shall remain in full force and effect."
Section 3: All ordinances or parts of ordinances, in any manner conflicting herewith are hereby repealed.
Section 4: This ordinance shall become effective upon its publication as required by law.
