 AN ORDINANCE AMENDING ORDINANCE NO. 387-87 REZONING PROPERTY OWNED BY RW & DELORIS TEEM FROM AO - AGRICULTURAL OPEN SPACE & R1D - RESIDENTIAL SINGLE FAMILY TO TH1 - RESIDENTIAL TOWNHOME DISTRICT

 

 

Body

WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a new Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and

 

WHEREAS, the Planning Commission has recommended approval of this rezoning, and

WHEREAS, the City of Foley has received a request that specific property within the City be re-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and

WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met,

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA while in regular session accepted the following changes:

Section 1.                     That the official Zoning Map of the City of Foley, Alabama be amended to rezone the portion of property previously zoned AO - Agricultural Open Space and R1D - Residential Single Family to TH1 - Residential Townhome said property description as follows:

DESCRIPTION PER INSTRUMENT 1473462:

Tract 1:

The Southwest Quarter of the Southwest Quarter of Section 5, Township 8 South, Range 4 East, Baldwin County, Alabama; LESS AND EXCEPT approximately 3 acres described as follows: Commence at the Southwest corner of Section 5, Township 8 South, Range 4 East, Baldwin County, Alabama; run thence East for a distance of 1222 feet to a point; thence run North 40 feet to a point on the North right-of-way line of Baldwin County Road 20 for the Point of Beginning; thence continue North for a distance of 1282 feet to a point; thence run East for a distance of 110 feet to a point; thence run South for a distance of 1283 feet to a point; thence run West to the Point of Beginning; lying inside Foley corporate limits; ALSO LESS AND EXCEPT approximately 1.4 acres described as follows: Commencing at the Southwest corner of the Southwest Quarter of the Southwest Quarter of Section 5, Township 8 South, Range 4 East, Baldwin County, Alabama, run East along the South boundary of said Section 5 a distance of 994.27 feet to a point; thence run North a distance of 40.00 feet to a point on the North right-of-way line of Baldwin County Road 20 and the Point of Beginning of the property herein described; thence continue North for a distance of 280 feet to a point; thence run East for a distance of 215 feet to a point; thence run South for a distance of 280.0 feet to a point on the aforementioned North right-of-way line of Baldwin County Road 20; thence run West along said North right-of-way line of Baldwin County Road 20 a distance of 215.00 feet to the Point of Beginning; containing 1.382 acres.

Commencing at the Southwest corner of the Southwest quarter of the Southwest quarter of Section 5, Township 8 South, Range 4 East, Baldwin County, Alabama, run East along the South boundary of said Section 5 a distance of 994,27 feet to a point; thence run North a distance of 40.00 feet to a point on the North right of way line of Baldwin County Road No. 20 and the Point of Beginning of the property herein described; thence continue North for a distance of 280.00 feet to a point; thence run East a distance of 215 feet to a point; thence run South a distance of 280.00 feet to a point on the aforementioned North right of way line of Baldwin County Road No. 20; thence run West along said North right of way line of Baldwin County Road No. 20 a distance of 215.00 feet to the Point of Beginning; containing 1.382 acres.

Tract 3:

Commence at the Southwest corner of Section 5, Township 8 South, Range 4 East, Baldwin County, Alabama; run thence East for a distance of 1222 feet to a point; thence run North 40 feet to a point on the North right-of-way line of Baldwin County Road 20 for the Point of Beginning; thence continue North for a distance of 1282 feet to a point; thence run East for a distance of 110 feet to a point; thence run South for a distance of 1283 feet to a point; thence run West to the Point of Beginning; lying inside the corporate limits of the City of Foley and containing 3 acres, more or less.

SECTION 2: That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.

 

SECTION 3:  This Ordinance shall become effective immediately upon its adoption as required by law.
