A Resolution to Approve the Re-subdivision of the Wilson Pecan Property, a Land Swap Between the PFCD and the City of Foley and the Transfer of Property to the PFCD

WHEREAS, Engineering DesignGroup, LLC submitted the attached Re-subdivision of Parcel 1 Wilson-Pecan Property Minor Subdivision for approval, and
WHEREAS, the City of Foley, who owns property due north of the Coastal Alabama Farmers and Fishermens Market, wishes to exchange a small portion of the property located at the southwestern portion of Lot 3 containing approximately .59+/- acres for a portion of the property the Cooperative District owns on the northern portion of Lot 4 containing approximately .52+/- acres, and
WHEREAS, the land swap would be advantageous in that the property would be solely owned by the City of Foley, and
WHEREAS, the City of Foley also desires to transfer a portion of real property containing approximately .15 acres and located due north of Lot 8 owned by the PFCD.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Approves the re-subdivision of the Wilson-Pecan property as shown in the attachment and made a permanent part of this resolution contingent upon approval by the Planning Commission.
SECTION 2: Declares the southwesternmost portion of Lot 3, Parcel 05-61-02-04-0-000-012.009 for a total of approximately .59 acres more or less as surplus and authorizes the disposal of same.
SECTION 3: Approves the land swap between the City of Foley and the Public Facilities Cooperative District and authorizes the Mayor and the PFCD Chairman to execute an original plat map detailing the land swap as shown in the attachment and made a permanent part of this resolution.
SECTION 4: Approves the transfer of the small portion of property containing approximately .15 acres to the Public Facilities Cooperative District located north of Lot 8 as shown in the attachments and made a permanent part of this resolution.
SECTION 5: This Resolution shall become effective immediately upon its adoption as required by law.
