WHEREAS, under the provisions of Ala. Code § 11-43-55, the City Council is authorized to provide all things necessary for the maintenance of an efficient police department;
WHEREAS, under the provisions of Ala. Code § 11-43-56, control over all City property vests in the City Council;
WHEREAS, on occasion, the Mayor, the City of Foley Chief of Police and other municipal officers find it necessary and desirable to augment the provision of public safety and services during the course of these events by borrowing equipment from other political subdivisions, governmental entities or tribal governments;
WHEREAS, on occasion, other political subdivisions, governmental entities and tribal governments may find it necessary and desirable to borrow equipment from the City of Foley in order to enhance their level of public safety and services;
WHEREAS, the City Council recognizes and agrees it to be reasonable and in the best interests of the health, safety and welfare of the citizens to authorize the Mayor, the City of Foley Chief of Police and other municipal officers to enter into Equipment Loan Agreements (attached hereto as Exhibit A) whereby the City may borrow or lend equipment;
WHEREAS, the City of Foley desires to set forth a process governing the interchange of such equipment; and
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Foley, Alabama as follows:
SECTION 1: That the Mayor, the City of Foley Chief of Police, and other municipal officers are hereby authorized to enter into an Equipment Loan Agreement concerning the interchange and use of equipment within the City of Foley provided that interchange conforms to the procedures set out in Exhibit A, which from time to time may be updated by the Risk Manager, and incorporated herein by reference.
SECTION 2: That this Resolution is hereby declared to be a measure necessary for the preservation of the public, health, safety, and welfare of the citizens of the City of Foley, Alabama,
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
