Body

                     WHEREAS, Council adopted Ordinance 18-2004 Building Code and Fee amendments during the regular scheduled Council meeting of March 5th 2018, and

 

WHEREAS, the section regarding Section 4, Permit Fees needs to be amended to reflect the changes as attached and made a permanent part of this ordinance.

 

WHEREAS, This Ordinance to become effective 30 days after adoption.

 

BE IT ORDAINED that the Foley City Council as follows:

 

Section 1. Permit Fees.

Each person, firm, corporation, or other entity engaged in any construction or construction-related activity for which a City building permit is required shall, before the commencement of work, pay the appropriate building permit fee. For the purpose of determining the fee for the issuance of a building permit, the value of the proposed work shall be determined by the City of Foley Building Department, which may consider the most current version of the Building Valuation Data published by the International Code Council, signed contracts, local averages based on the square footage of the project, or any other reliable evidence of the cost or value of the work. The following fees shall be charged for the issuance of building permits based on the total value of work, including materials and labor.

For the purpose of calculating permit and Impact fees, the valuation utilized shall be the greater of the calculated valuation or the stated valuation.

 

For new single/two-family dwellings, and townhouse construction, the building valuation shall be calculated on a square foot basis utilizing standardized construction cost data published in the International Code Council Building Valuation Data (BVD) as follows:

Conditioned Spaces: 85% of the Square Foot Construction Costs specified in the BVD using the "R-3 Residential, and two-family" ICC Group classification and the "VB" ICC construction type column. Unconditioned Spaces: 100% of the Square Foot Construction Costs specified in the BVD using the "U Utility, miscellaneous" ICC Group classification and the ICC construction type column.

Any new residential construction that is not a single/two family dwelling, or townhouse permitted under the International Residential Code shall be subject to the Commercial Construction Permits Fees specified in Section 5.

 

Section 2. Building Permit Fees Based on Valuation.

 Fees based on valuation shall be determined by the following schedule:

 Project Valuation -                                       Permit Fee

$1,001 to $50,000 -                                         $100 for the first $1,000

$50,001 to $100,000 -                                                         $590 for the first $50,000

                                                                                                  Plus $8 for each additional $1,000 or fraction thereof.

 

$100,001 to $500,000 -                                                         $990 for the first $100,000

                                                                                                  Plus $6 for each additional $1,000 or fraction thereof.

 

$500,001 and up -                                                         $3,390 for the first $500,000

                                                                                                  Plus $4 for each additional $1,000 or fraction thereof.

Section 3. Plan Review Fees.

When commercial or residential building plans are submitted for review under the International Building Code or the International Residential Code, a plan review fee shall be paid to the Building Department at the time of submission of the plans and specifications for review.

 

Section 4. Residential Construction Permit Fees.

(a) New Construction:

 (1) Plan Review: Single and Two-Family Dwellings or Townhouses - $150 per dwelling unit. Multi-family buildings permitted under the International Building Code shall be calculated as commercial.

 (2) Building Permit: See Building Permit Valuation Fee in Section 2.

 (3) Electrical Permit: $150 per Dwelling Unit.

 (4) Plumbing Permit: $150 per Dwelling Unit.

 (5) Mechanical Permit: $150 per HVAC Unit.

 (6) Gas Permit (Liquid Petroleum Only): $150 per dwelling.

(b) Miscellaneous Residential Permit Fees:

 (1) Plan Review: Remodeling, Addition, Alteration, or Repairs where project valuation exceeds   $10,000 shall be assessed $75.

 (2) Remodeling, Addition, Alteration, or Repair - Building Permit: See Building Permit Valuation Fee in Section 2.

 (3) Remodeling, Addition, Alteration, or Repair - Electrical Permit: $100.

 (4) Remodeling, Addition, Alteration, or Repair - Plumbing Permit: $100.

 (5) Remodeling, Addition, Alteration, or Repair - Mechanical Permit: $100 per HVAC unit.

 (6) Swimming Pool or Spa: See Building Permit Valuation Fee in Section 2.

 (7) Reroofing: See Building Permit Valuation Fee in Section 2.

 (8) Electrical Service Panel or Meter Replacement Only: $100.

 (9) Residential Generator or Transfer Switch Installation: $100.

 (10) Residential Pool or Spa Electrical Equipment: $100.

 (11) Sewer Line Installation or Replacement Only: $100.

 (12) HVAC Unit Replacement Only: $100 per HVAC unit.

 (13) Manufactured Home Installation: $100.

 (14) Manufactured Home Installation Electrical: $100.

 (15) Demolition: $100 per structure.

 (16) Contractor Temporary Power Pole Only: $100.

 (17) Fence or Pool Barrier: See Building Permit Valuation Fee in Section 2.

 (18) Re-Inspection Fee: $75 when not prepared for scheduled inspection or for any re-inspection of the same item. A $150 fee shall apply for any additional inspection for the same item if the issue persists after the first re-inspection. This fee will apply to any subsequent inspections until a passing inspection is made and must be paid prior to any subsequent inspection.

Section 5. Commercial Construction Permit Fees.

(a) New Construction:

 (1) Plan Review: Equal to one-half of the permit fee.

 (2) Building Permit: See Building Permit Valuation Fee in Section 2.

 (3) Electrical Permit: See Trade Permit Valuation Fee in Section 6.

 (4) Plumbing Permit: See Trade Permit Valuation Fee in Section 6.

 (5) Mechanical Permit: See Trade Permit Valuation Fee in Section 6.

(b) Miscellaneous Commercial Fees:

 (1) Plan Review: For any Commercial Remodel, Addition, Alteration, or Repair Shall be Equal to one-half of the permit fee.

 (2) Remodeling, Addition, Alteration, or Repair - Building Permit: See Building Permit Valuation Fee in Section 2.

 (3) Remodeling, Addition, Alteration, or Repair - Electrical Permit: See Trade Permit Valuation Fee in Section 6.

 (4) Remodeling, Addition, Alteration, or Repair - Plumbing Permit: See Trade Permit Valuation Fee in Section 6.

 (5) Remodeling, Addition, Alteration, or Repair - Mechanical Permit: See Trade Permit Valuation Fee in Section 6.

 (6) Swimming Pool or Spa: See Building Permit Valuation Fee in Section 2.

 (7) Swimming Pool or Spa Electrical: See Trade Permit Valuation Fee in Section 6.

 (8) Reroofing: See Building Permit Valuation Fee in Section 2.

 (17) Manufactured, Modular, or Mobile Building for Temporary Commercial Use: $225 for a six-month period, renewable for the same fee with approval.

 (18) Manufactured or Modular Building - Temporary Construction Field Office: $225 for a six-month period, renewable for the same fee with approval.

 (19) Manufactured or Modular Building - Temporary Watchman’s Quarters: $225 for a six-month period, renewable for the same fee with approval.

 (20) Tent or Membrane Structure for Temporary Commercial Use: $100 per period.

 (21) Signs: See Building Permit Valuation Fee in Section 2.

 (22) Change of Occupancy Permit: $150. This permit applies only if a Building Permit is not required.

 (23) Re-Inspection Fees: See Section 4(b)(18).

 (24) Working Without a Permit Penalty: See Section 8(c).

Section 6. Trade Permit Fees Based on Valuation.

 Commercial trade permit fees shall be based on the total valuation (material and labor) of the work to be performed, as determined by the City of Foley Building Department, which may require signed contracts or other reliable evidence of valuation.

Section 7. Miscellaneous and Administrative Fees.

 (a) Moving a Building or Structure: $100.

 (b) Permit Placard Replacement Fee: $50.

 (c) Permit Extension Fee: $100.

 (d) Temporary Certificate of Occupancy Administrative Fee: $100.

 (e) General Administrative Fee (when services are rendered and no other fee applies): $50

 (f ) Plan Revision/Addendum Review Fee: $50 Per Plan Revision/Addendum (fee applies to issued permits).

 (g) Flood Determination Letter Fee: $50       

 

Section 8. Additional Provisions.

(a) Weekend or After-Hours Inspections: Fees for after-hours or weekend inspections shall be paid prior to scheduling and shall be in addition to all other fees. Such fees shall be $75 per hour Per Inspector or portion thereof, with a minimum charge of four hours. Normal business hours of the Building Department shall be posted within the office of the Department.

(b) Additional Work: If additional installations or alterations are required during permitted work, it shall be unlawful for the permit holder to fail to immediately remit to the Building Department the additional fees required under this ordinance.

(c) Working Without a Permit: When work for which a permit is required is commenced prior to obtaining a permit, the applicant shall be required to pay a permit fee equal to double the normal fee. Payment of the double fee shall not relieve any person from compliance with applicable regulations and codes, nor from penalties including suspension or termination of work. In addition to double permit fees, a fine of $150 will be assessed for the first offense and $300 for the second offense, along with a citation requiring a court appearance.

(d) Unused Permits and Refunds: The City Clerk may authorize refunds within 180 days of permit issuance upon written request and Building Official certification. Refunds shall be processed as follows:

 (1) If the permit is cancelled and no work has begun, a refund may be issued less a $100 administrative charge.

 (2) If work has begun but will not be completed, a prorated refund of 75 percent if no inspections occurred and 50 percent if only one inspection was completed, less a $100 administrative charge.

 (3) Plan review fees are non-refundable.

Appendix A: Planning and Zoning Fees.

(a) Zoning Plan Review:

         (1)Residential plans - $25 per plan;

         (2)Commercial plans - $50 per plan.

(b) Zoning Verification Letter: $25.

(c) Pre-Application Meeting Fee: $50

(d) Annexation and Initial Zoning Fee: $250 (submitted with the petition for annexation and zoning

request form attached to the petition)

(e) Rezoning by Petition of Property Owner: $500 (plus the cost of certified mailing) for 20 acres or less,

plus $15 per acre for each acre over 20 acres.

(f) Pre-Zoning Fee: $500 (plus the cost of certified mailing) for 20 acres or less, plus $15 per acre for each

acre over 20 acres.

(g) Subdivision Fees:

Preliminary Plat - $250 plus $30 per lot (plus certified mailing cost).

      (2) Final Plat - $150 plus $20 per lot.

      (3) Minor Subdivision - $250 plus $30 per lot (plus certified mailing cost).

(h) Site Plan Review by Planning Commission Fee: $250

(I) Final Site Plan Fee: $150

(j) Application for Extension Fee: $250

(k) Conditional Use Request at Planning Commission Fee: $150 (plus certified mailing cost)

(l) Board of Adjustment and Appeals Fees: Applications for interpretations, special exceptions, or

variances must be accompanied by a payment of $150 (plus certified mailing cost)

 

Appendix B: Fire Department Permit Fees

 

(a) Fire Sprinkler Permit:

New construction- $150

Addition, Alteration, Repair-$100

(b) Fire Alarm Permit:

New construction- $150

Addition, Alteration, Repair-$100

(c) Fire Extinguishing System Permit:

Appendix C: Land Development/Disturbance Fees

 

Land Development Permit Fee: $750 plus $5 per acre for developments over 5 acres (exclusive of lands placed into conservation easements)

Right-of-Way Permit Fee: $50

Annual Minor Right-of-Way Permit Fee: $100

Driveway Permit Fee: $25

Erosion & Sediment Control Permit Fee: $50

Coastal Construction Permit Fee: $75

Heritage Tree Removal Permit Fee: $25

 

                     

Section 2:                     "The terms and provisions of this ordinance are severable.  If any part or portion of this ordinance is declared invalid, void, or unconstitutional, that portion shall be deemed severed, and the remaining portions of the ordinance shall remain in full force and effect."

Section 3:                     All ordinances or parts of ordinances, in any manner conflicting herewith are hereby repealed.

Section 4:                     This ordinance shall become effective upon its publication as required by law.
