A RESOLUTION AUTHORIZING THE PURCHASE AND
ACCEPTANCE OF CERTAIN REAL PROPERTY
(Otis L. Gatlin, David Gatlin, Victoria G. Young, James M. Gatlin and John S. Gatlin, Jr.)

WHEREAS, Otis L. Gatlin, David Gatlin, Victoria G. Young, James M. Gatlin and John S. Gatlin, Jr. (collectively “Gatlin”), owns certain real property identified as PPIN 15665 consisting of approximately 2 +/- acres in Foley, Alabama described as follows:
All of Lot One (1) East of the L & N Railroad Switch, which formerly existed on this property, and extending Fourt (4) feet from the West rail of said Switch, and Lots Two (2) and Three (3) and the North Fifty-six (56) feet of Lot Fourt (4), and all of Lots Thirteen (13) and Fourteen (14) and Fifteen (15), all in Block One (1) in the Town of Foley, Alabama, according to the play thereof on file in the Office of the Judge of Probate of Baldwin County, Alabama; meaning and intending to describe the same property conveyed by J. A. Pilgrim and wife to W.M. Patterson and B. E. Eastburn under and by virtue of the terms of that certain deed dated January 11, 1946, and recorded in the Probate Judge of Baldwin County, Alabama, in Deed Book 102 N.S., page 338.

WHEREAS, the City of Foley (the “City”) desires to purchase the Property on certain terms, conditions, and understandings; and
WHEREAS, Gatlin also owns certain real property identified as PPIN 64976 in Foley, Alabama consisting of approximately 0.3 +/- acres and described as follows:
Lot Three (3), Block Two (2), in Foley, being a subdivision of apart of sections 28 and 29, Township 7 South, Range 4 East, Baldwin County, Alabama.
(See deed recorded in Deed Book 72ns, page 410, in the office of the Judge of Probate of Baldwin County, Alabama, to above grantors.)

Lot 4, Block 2 of the Magnolia Springs Land Company Subdivision of the Town of Foley, According to the plat thereof as recorded in May Book 1, at Page 25 in the office of the Judge of Probate of Baldwin County, Alabama.
(the “Donation Property”); and
WHEREAS, Gatlin desires to gift and donate the Donation Property to the City and the City desires to acquire and accept the Donation Property from Gatlin in accordance with certain terms, conditions, and understandings; and
WHEREAS, the City finds that these transactions will serve a public purpose;
NOW, THEREFORE, be it resolved by the City Council of the City of Foley at its meeting on the 6th day of October, 2025 as follows:
1. That the Mayor, Assistant City Clerk, and other municipal officers, or any one or more of them, are hereby authorized and directed to do execute such documents and to pay such sums of money as are necessary or required to carry forward and purchase the Property and to acquire and accept the Donation Property.
2. That all prior actions taken by any elected or appointed officers or by any employees or agents of the City of Foley in connection with the purchase of the Property or the acquisition and acceptance of the Donation Property are hereby ratified and affirmed.
3. Appropriates $1,505,000 to account 400-1010-5107 LP-5.
