Body

WHEREAS, The Environmental and Building Departments request to set a public hearing declaring the accumulation of junk, trash, and litter a public nuisance and deeming a burned dwelling Unsafe therefore ordering its abatement at 3915 Linton Ln. Since December 2025, multiple departments have sent certified notification letters to the property owner and made site visits, phone calls, and email correspondence with the occupants and property owner of record. No improvements or progress has been made on the property toward abatement. and

 

WHEREAS, investigations by City forces have substantiated the accumulation of junk, trash, and litter viewable from the public rights-of-way is of the type and character that can be a public nuisance as defined in the City Ordinance 1066-08, and the burned dwelling located at the rear of the property meets  the definition of an unsafe structure as specified in Section 109.1.1 of the adopted 2024 International

Property Maintenance Code.

 

WHEREAS, the City Council of Foley will now give notice as prescribed by the State of Alabama Code, 1975, §11-67-22 and §11-67-23, of a Public Hearing to be held to determine if the area should be declared a public nuisance and give the property owners an opportunity to remove the junk, trash, Unsafe Structure, and litter from the yards viewable from public rights-of-way.

 

NOW, THEREFORE BE IT RESOLVED by the Foley City Council in regular session on the 18th day of

May, 2026, as follows:

 

Section 1: Notice of public hearing on the matter shall be given by certified mail, return receipt requested to the property owners.

 

Section 2: Notice shall also be giver in the Onlooker or The Baldwin Times one a week for

two consecutive weeks. The first notice shall be published at least fourteen (14) days prior to the date

 

Section 3: Two signs shall be conspicuously posted on the properties described in this resolution. The wording of the signs shall be not less than one inch in height and shall be substantially in the form of the notice contained in Section 11-67-23 of the State of Alabama Code. The notice shall be posted at least seven days prior to the time for the public hearing to hear objections to declaring the property, as described in this resolution, a public nuisance.
