In reviewing the Resolution Mr. Abrams questioned the one percent user fee and this began a discussion resulting in amending the percentage from one percent to five percent. In discussing this with the City's attorney this was incorrect and Resolution 16-0128-PFCD needs to be rescinded. The description of the project also needs to be amended to include

WHEREAS, Resolution 16-0128-PFCD was adopted on May 2, 2016 by the City of Foley Public Facilities Cooperative District and amended the User Fee percent from one percent to five percent, and
WHEREAS, the description to be amended to state that Phase 2 would begin at the north side of Pet Smart and end on the south side of that section just north of the cement plant, and
WHEREAS, in reviewing the information with the City's attorney it was discovered that the User Fee should have remained the same.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Rescinds Resolution 16-0128-PFCD.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
