American Legion's request to continue their turkey shoot

On behalf of the American Legion Commander Chavis requests the following:
1) Permission from the Council to continue the turkey shoot at the American Legion's location (in accordance with the City Ordinance 1007-07);
2) Request a modification in that the turkey shoot, though within close proximity of adjacent businesses, has no buildings 200 yards down range from the firing line; and
3) Shotguns will only be used for this event; and
4) Turkey Shoots will occur once a month from September 2016 through April 2017 starting on Sunday, September, 2016; and
5) They will have to come back in September 2017 to request permission for the turkey shoot to be held once a month beginning September 2017 through April 2018.

WHEREAS, the American Legion requests to hold a monthly turkey shoot from September 11, 2016 through April, 2017 as part of their fundraising; and
WHEREAS, while they are within close proximity of adjacent businesses, they have no buildings 200 yards down range from the firing line; and
WHEREAS, they will need to move the shooting line forward according to Foley's Police Chief.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Approves the American Legion holding a turkey shoot from September 11, 2016 through April 2017 once a month using shotguns only provided they move the firing line forward according to the location set forth by the Foley Police Chief. The approval is dependant upon the growth surrounding the American Legion and if at any time the growth moves within 200 yards down range of the firing line this approval becomes null and void in order to keep the public safe from harm or danger. At that time the American Legion will either need to select a different location to hold the turkey shoot fundraiser or elect to hold a different fundraiser at its current location.
SECTION 2: The American Legion will return in September 2017 to request permission for the turkey shoot to be held once a month beginning September 2017 through April 2018.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
