WHEREAS, the Foley Municipal Airport contains petroleum storage and maintenance areas exposed to stormwater, and
WHEREAS, the existing No Exposure Certification from ADEM for the Foley Municipal Airport expired in 2008, and
WHEREAS, ADEM conducted an inspection on September 23, 2014 of the facilities and discovered the lack of permit coverage or no exposure certification, and
WHEREAS, the City of Foley received a notice from ADEM on October 7, 2014 requiring NPDES General Permit ALG140000, with a fee of $1155, or No Exposure Certification for the Foley Municipal Airport within 30 days, and
WHEREAS, Volkert has submitted a proposal to apply for the permit and develop a Best Management Practices Plan and Sampling Plan for the Airport at a lump sum fee of $8500.00.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Approves the contract by Volkert at a fee of $8500 to apply for the required permit for the Airport with necessary plans and a fee of $1155.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
