Mayor Koniar's term expires on October 1, 2015. He is willing to serve another term. The term of office will now run concurrently with the Mayoral term of office ending on November 7, 2016.
Body
WHEREAS, the Code of Alabama, 1975, Section 11-50-313 states where "the governing body of any municipality which has heretofore or hereafter authorized the creation of a corporation as provided in this article may increase the board of directors from three to five members to serve according to all the conditions and terms set forth in this article.", and
WHEREAS, Section 11-50-313 further states, "At no time shall the board consist of more than three officers to the municipality. Any officer of the municipality appointed to serve as a member of the board of directors shall serve for the term for which he or she is appointed or during his or her tenure as a municipal officer, whichever expires first.", and
WHEREAS, the State of Alabama Ethics Commission says that public officials/board members fall under the State Ethics Law, and therefore should have the opportunity to educate themselves regarding this law, and
WHEREAS, the Alabama Ethics Commission has recently developed an online video training of the Alabama Ethics Law, which can be accessed at their website at www.ethics.alabama.gov, and
WHEREAS, all newly appointed and reappointed board members must submit a copy of their training certification to the City of Foley as a condition to being appointed/reappointed to the boards.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Reappoints John Koniar to the Riviera Utilities Board beginning October 2, 2015 and ending on November 7, 2016 to run concurrently with the Mayoral term of office as stated in the Code of Alabama, 1975, Section 11-50-313, based on the conditions that he submits a copy of the Alabama Ethics Law certification to the City Clerk to be included in the City's General Files.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
