Title

RESOLUTION ADOPTING TRANSPORTATION PLAN PURSUANT TO THE REBUILD ALABAMA ACT

 

Body

 

WHEREAS, the Alabama Legislature adopted Act No. 2019-2 (the “Act”), known as the Rebuild Alabama Act, to levy an additional excise tax on gasoline and motor fuel; and

 

WHEREAS, the Rebuild Alabama Act provides for an allocation among the municipalities of the State of Alabama of a portion of the additional taxes levied under the Act to be used for transportation and infrastructure improvement, preservation, and maintenance; and

 

WHEREAS, the Act provides that the municipal governing body shall adopt an annual Transportation Plan which provides a detailed list of projects for which expenditures are intended to be made during the next fiscal year; and

 

WHEREAS, the City of Foley has identified the City of Foley Annual Resurfacing Project as a transportation project to be undertaken during Fiscal Year 2027; and

 

WHEREAS, the City of Foley Annual Resurfacing Project for Fiscal Year 2027 includes approximately 6.2 miles of asphalt pavement resurfacing along existing paved roadways throughout the City and is part of the City’s ongoing annual roadway resurfacing program intended to maintain and improve the condition, serviceability, and longevity of the City’s existing roadway network; and

 

WHEREAS, bids for the project were received and publicly opened on August 11, 2026, and the lowest responsible bid was submitted by Asphalt Services, Inc., in the amount of One Million Eighty-Two Thousand Fifty-Eight Dollars and Seventy Cents ($1,082,058.70); and

 

WHEREAS, pending Council approval the construction of the project is anticipated to begin in October 2026 and is expected to be completed in April 2027.

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, as follows:

 

Section 1: That the City Council of the City of Foley hereby adopts this Resolution as its Transportation Plan for the fiscal year beginning October 1, 2026, and ending September 30, 2027, in compliance with the Rebuild Alabama Act, Act No. 2019-2.

 

Section 2: Pursuant to the Act, the City anticipates expending funds received pursuant to the Rebuild Alabama Act, in whole or in part, for the following transportation project:

 

City of Foley Annual Resurfacing Project - Fiscal Year 2027

 

The project includes approximately 6.2 miles of asphalt pavement resurfacing along existing paved roadways throughout the City of Foley. The project is intended to maintain and improve the condition, serviceability, and longevity of the City’s existing roadway network.

 

The contract amount for the project is One Million Eighty-Two Thousand Fifty-Eight Dollars and Seventy Cents ($1,082,058.70), based upon the lowest responsible bid submitted by Asphalt Services, Inc.

 

 pending Council approval the construction is anticipated to begin in October 2026, with an estimated construction duration of six (6) months and anticipated completion in April 2027.

 

Section 3: That the City Clerk is hereby authorized and instructed to post a copy of this Resolution as the City’s Transportation Plan at City Hall and on the City of Foley website.

 

Section 4: That the Treasurer is hereby authorized and directed to maintain a separate fund for the receipt and deposit of funds received pursuant to the Rebuild Alabama Act, the proceeds of which shall be expended solely for the maintenance, improvement, replacement, and construction of roads and bridges maintained by the City and such other uses as are authorized by the Act.

 

Section 5: That this Resolution shall take effect upon its passage and adoption by the City Council.
