Resolution Approving the Impact Fee Study Proposal from TischlerBise.
Summary
Description of Topic: (who, what, where, when, why and how much) The City of Foley seeks a consultant to review and update the City’s Impact Fee Program. There have been significant updates to data sources used in the previous calculations in the City’s last impact fee study (2021). Additionally, there have been several state and national impact fee court case decisions that influence how impact fees are calculated. As part of this effort, TischlerBise will provide a comprehensive evaluation of the City’s current impact fee categories as well as advise the City as to whether there are other infrastructure categories the City should consider as well. When preparing the capital improvement plan and recommended impact fee structure, TischlerBise will work with City staff to ensure assumptions and methodologies are consistent with recommended City policy directives and strategic objectives. This study will be funded with impact fee funds.

WHEREAS, The City of Foley seeks a consultant to review and update the City's Impact Fee Program; and
WHEREAS, there have been significant updates to data sources used in the previous calculations in the City's last impact fee study in 2021; and
WHEREAS, there have been several state and national impact fee court case decisions that influence how impact fees are calculated; and
WHEREAS, TischlerBise submitted an impact fee study proposal in the amount of $65,960; and
WHEREAS, TischlerBise will provide a comprehensive evaluation of the City's current impact fee categories as well as advise the City as to whether there are other infrastructure categories the City should consider as well; and
WHEREAS, when preparing the capital improvement plan and recommended impact fee structure, TischlerBise will work with City staff to ensure assumptions and methodologies are consistent with recommended City policy directives and strategic objectives, and
WHEREAS, the this cost will be paid out of the impact fees collect.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Approve the use of impact fee collections to fund a study proposal from TischlerBise and appropriate $65,960 to Account No# 208-1011-6020.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
