The City of Loxley has requested the donation of six railroad right-of-way parcels that are located in Loxley for the purpose of developing a public trail as described in the Central Baldwin Rail-to-Trail Project included in their Comprehensive Plan.   The parcels proposed for conveyance are identified by Baldwin County GIS as PIN Nos. 084217, 388395, 341610, 084220, 638647, and 092523.

Body

 

WHEREAS, the City of Loxley desires to move forward with the Central Baldwin Rail-to-Trail Project as identified in the City of Loxley Comprehensive Plan; and

 

WHEREAS, the purpose of the project is to convert the former north-south railroad corridor into a public trail that is safe, accessible, and beneficial to the surrounding communities by promoting connectivity, recreation, outdoor activity, and enhancement of adjacent properties and public areas; and

 

WHEREAS, the City of Foley currently owns certain former L&N Railroad Right-of-Way parcels located within the municipal limits and/or planning jurisdiction of the City of Loxley, Alabama; and

 

WHEREAS, the City of Loxley has requested that the City of Foley donate and convey said parcels to the City of Loxley for use in connection with the Central Baldwin Rail-to-Trail Project and related public purposes; and

 

WHEREAS, the Foley City Council has determined that the parcels described herein are no longer needed for municipal purposes by the City of Foley and that the conveyance of said parcels to the City of Loxley serves a valid public purpose and is in the best interest of the public; and

 

WHEREAS, the parcels proposed for conveyance are identified by Baldwin County GIS as PIN Nos. 084217, 388395, 341610, 084220, 638647, and 092523.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, as follows:

 

SECTION 1: The City Council hereby determines that the following former L&N Railroad Right-of-Way parcels owned by the City of Foley are no longer needed for municipal purposes by the City of Foley:

 

Baldwin County GIS PIN No. 084217

Baldwin County GIS PIN No. 388395

Baldwin County GIS PIN No. 341610

Baldwin County GIS PIN No. 084220

Baldwin County GIS PIN No. 638647

Baldwin County GIS PIN No. 092523

 

SECTION 2: The City Council hereby approves the donation and conveyance of the above-described parcels to the City of Loxley, Alabama, for public purposes associated with the Central Baldwin Rail-to-Trail Project and related governmental and recreational uses.

 

SECTION 3: The Mayor is hereby authorized to execute and deliver all deeds, closing documents, and other instruments necessary to complete the conveyance of the parcels described herein to the City of Loxley, Alabama. The City Clerk is further authorized to attest all such documents as required by law.

 

SECTION 4: If any section, subsection, sentence, clause, or phrase of this Ordinance is held unconstitutional or otherwise invalid, such decision shall not affect the remaining portions of this Ordinance.

 

SECTION 5: This Ordinance shall become effective immediately upon its adoption and publication as required by law.
