WHEREAS, the City of Foley, Alabama is authorized to regulate development, land disturbance, construction standards, environmental protections, and related engineering requirements within it's jurisdiction; and
WHEREAS, the Environmental and Engineering Departments have prepared a Traffic Calming Policy update to the Technical Design Manual (TDM) to consolidate, modernize, and organize these standards into a single comprehensive ordinance;
WHEREAS, the Foley City Council finds that adoption of the Traffic Calming Policy update to the Technical Design Manual (TDM) will improve development standards, administrative efficiency, and protection of public health, safety, welfare, and environmental resources within the City.
BE IT ORDAINED that the Foley City Council as follows:
Section 1: The Traffic Calming Policy update to the Technical Design Manual (TDM), attached hereto and incorporated herein by reference, is hereby adopted as the official engineering, development, permitting, and construction standard for the City of Foley, Alabama
Section 2: Ordinance 26-2011, is hereby repealed and superseded by this Ordinance
Section 3: The provisions of this ordinance declared to be severable. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the remaining portions of this ordinance
Section 4: All ordinances or parts of ordinances in conflict with provisions of this ordinance are hereby repealed.
Section 5: This ordinance shall become effective upon its publication as required by law.
