Body
      WHEREAS, Ordinance No. 607-99 was approved by the City Council on May 25, 1999 adopting Article II, Planned Access Roadways which provided for an application fee for connection access permits but did not specify the amount of the fee, and
 
WHEREAS, Ordinance No. 715-02 was approved by the City Council on January 21, 2002 adopting a connection access permit fee of $300.00 and a severability clause, and
 
      WHEREAS, revisions have been made to Exhibits D and E of the Access Management Plan set forth in Article II, Planned Access Roadways.
 
BE IT ORDAINED that the Foley City Council as follows:
 
SECTION 1.      Exhibits D and E of the Access Management Plan shall be replaced with the revised Exhibits D (200) and E (200) for Foley Beach Express access units in sections where the right of way that is 200 feet wide.   In addition, Exhibit E (150), for Foley Beach Express access units shall apply to sections where the right of way that is 150 feet wide.  Said Exhibits shall be incorporated into the Access Management Plan and shall replace the original Exhibits D and E.  The replacement Exhibits reduce the overall length of the access units in Exhibits D and E from 1,795 feet to 1,320 feet, with subsequent reductions in the acceleration lengths.
 
Section 2.      "The terms and provisions of this ordinance are severable.  If any part or portion of this ordinance is declared invalid, void, or unconstitutional, that portion shall be deemed severed, and the remaining portions of the ordinance shall remain in full force and effect."
 
Section 3.      All ordinances or parts of ordinances, in any manner conflicting herewith are hereby repealed.
 
Section 4.      This ordinance shall become effective upon its publication as required by law.
