ORDINANCE AMENDING ORDINANCE NO. 387-87
REZONING PROPERTY OWNED BY THOMAS PROVOST FROM PUD TO AO
WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and
WHEREAS, the City of Foley has received a request that specific property within the City be rezoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and
WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA while in regular session accepted the following changes:
SECTION 1. That the official Zoning map of the City of Foley, Alabama be amended to rezone the portion of property previously zoned PUD, Planned Unit Development to AO, Agricultural Open Space; said property description as follows from the Equity Trust Company Survey dated February 27, 2015:
Lot 2
A parcel of land lying in the Northwest Quarter of the Northeast Quarter of Section 25, Township 7 South, Range 3 East, Baldwin County, Alabama and being more particularly described as follows: Commencing at the purported Northeast corner of said Section 25; thence run South 89°31'30" West, a distance of 1,317.83 feet to a point; thence run South 00°05'09" West, a distance of 23.35 feet to a point on the South right-of-way line of Breckner Road; thence run South 89°31'38" West, along said South right-of-way line a distance of 334.00 feet to the Point of Beginning; thence run South 00°05'10" West, a distance of 1304.89 feet to a point; thence run South 89°37'49" West, a distance of 334.00 feet to a point; thence run North 00°05'11" East, a distance of 1034.29 feet to a point on the above mentioned South right-of-way line of Breckner Road; thence run thence run North 89°31'38" East along said right-of-way line, a distance of 334.00 feet to the Point of Beginning.

A parcel of land lying in the Northwest Quarter of the Northeast Quarter of Section 25, Township 7 South, Range 3 East, Baldwin County, Alabama and being more particularly described as follows: Commencing at the purported Northeast corner of said Section 25; thence run South 89°31'30" West, a distance of 1,317.83 feet to a point; thence run South 00°05'09" West, a distance of 23.35 feet to a point on the South right-of-way line of Breckner Road and the Point of Beginning of the parcel herein described, said point being the Northwest corner of Lot 17, Block F of Green Acres Estates, according to the map or plat thereof recorded in Map Book 8, Page 36, in the Office of the Judge of Probate of Baldwin County, Alabama; thence run South00°'05'09" West along the West line of said Green Acres Estates, a distance of 1305.49 feet to a point; thence run South 89°37'49" West, a distance of 334.00 feet to a point; thence run North 00°05'10" East, a distance of 1034.89 feet to a point on the above mentioned South right-of-way line of Breckner Road; thence run North 89°31'38" East, a distance of 334.00 feet to the Point of Beginning.
SECTION 2. That the official Zoning Map of the City of Foley be revised to indicate this amendment and is duly certified by the appropriate municipal officials.
SECTION 3. This Ordinance shall become effective immediately upon its adoption as required by law.
