WHEREAS, on May 1, 2015 the City of Foley's Public Facilities Cooperative District adopted Resolution PFCD 15-0111-RES conceptually agreeing to the transfer of approximately 1.4 acres of land for the use by Craine Creek Farms as a hydroponics production facility contingent upon the final plat being approved by the City of Foley's Planning Commission, and
WHEREAS, both parties have agreed that it is in the best interest of the City of Foley and Craine Creek Farms, LLC not to move forward with the agreement at this time.
NOW THEREFORE BE IT RESOLVED that the Public Facilities Cooperative District of the City of Foley, Alabama, as follows:
SECTION 1: Rescinds PFCD 15-0111-Res dissolving the agreement between the City of Foley and Craine Creek Farms, LLC and the transfer of the approximately 1.4 acres of land will remain in the name of City of Foley's Public Facilities Cooperative District until such time as the City of Foley may need it for another transaction.
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
