ORDINANCE AMENDING ORDINANCE NO. 387-87 REZONING PROPERTY OWNED BY THOMAS C. PROVOST FROM PUD - PLANNED UNIT DEVELOPMENT TO AO - AGRICULTURAL OPEN SPACE

 

Body

WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and

 

WHEREAS, the City of Foley has received a request that specific property within the City be re-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and

 

WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, while in regular session March 10, 2016 as follows:

 

Section 1.                     That the official Zoning Map of the City of Foley, Alabama be amended to rezone the portion of property previously zoned PUD - Planned Unit Development to AO - Agricultural Open Space; said property description as follows:

 

Parcel #05-55-07-25-0-000-044.000, PIN# 004500

 

Lot 1

A parcel of land lying in the Northwest Quarter of the Northeast Quarter of Section 25, Township 7 South, Range 3 East, Baldwin County, Alabama and being more particularly described as follows: Commencing at the purported Northeast corner of said Section 25; thence run South 89°31’30” West, a distance of 1,317.83 feet to a point; thence run South 00°05’09” West, a distance of 23.35 feet to a point on the South right-of-way line of Breckner Road; thence run South 89°31’38” West, along said South right-of-way line a distance of 668.00 feet to the Point of Beginning; thence run South 00°05’11” West, a distance of 1304.29 feet to a point; thence run South 89°37’49” West, a distance of 666.68 feet to a point on the East right-of-way line of Bodenhamer Road; thence run North 00°19’58” East along said East right-of-way line, a distance of 1303.16 feet to a point on the above mentioned South right-of-way line of Breckner Road; thence run thence run North 89°31’38” East, a distance of 661.08 feet to the Point of Beginning.

SECTION 2.                     That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.

 

SECTION 3:                      This Ordinance shall become effective immediately upon its adoption as required by law.
