Body
WHEREAS, the City of Foley, Alabama, adopted the following Ordinances 1170-11 on June 20, 2011 amending Ordinance No. 780-04 on April 19, 2004 amending Ordinance No. 523-96 amending Ordinance Number 387-87 on April 29, 1996 amending Ordinance Number 456-92, adopted by Foley City Council on February 27, 1992, establishing five single-member council districts for the City and further amending Section 6 of Ordinance Number 515-95, adopted by the Foley City Council on November 22, 1995, and
WHEREAS, the City of Foley has experienced significant increases in the population of the City and further, has annexed additional land into the City, both of which significantly impacted the socio-economic composition of the City and the population distribution within the City, and
WHEREAS, The Single Member Voting District Map and Chart depicts the population breakdown of each Single Member Voting District by population and by race. Both of these documents were prepared by the City of Foley and are attached hereto and made a part of this Ordinance by reference.
NOW, THEREFORE, BE IT ORDA1NED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, while in regular session this 15th day of February, 2016, as follows:
Section 1: Purpose
The purpose of this amendment is to make the minimum adjustments to the adopted and approved single-member council district boundaries that are necessary to maintain roughly equal proportions within each district, which are based on the 2010 U.S. Census of Population.
Section 2: Authority
The Ordinance set forth herein is adopted pursuant to authority granted by Section 11-40-8, 11-43-60 and 11-46-23 of Alabama Code (1975) and the amendment procedure approved and adopted by the Foley City Council.
Section 3: Adjustment of District Lines
The City of Foley is hereby divided into single-member council districts as listed and described herein and as illustrated on the Official Single-Member Voting District Map which is hereby adopted and made part of this Ordinance. The map shall be signed by the Mayor and attested by the City Clerk. It shall be filed in the Office of the City Clerk and shall show thereon the date of adoption of this Ordinance. The Ordinance and Map shall, within five days of the date of adoption, be certified by the Judge of Probate of Baldwin County and, within the same period, the Ordinance shall be published in a local newspaper and shall be posted at Foley City Hall, Foley Public Library and Foley Community Development Department.

Beginning at the intersection of the centerlines of County Road 28 and Juniper Street, which point is at or near the Northwest (NW) Corner of the Northeast Quarter (NE ¼) of Section 9, Township 7 South, Range 4 East, Baldwin County, Alabama; thence run West down the centerline of County Road 28 to its intersection with Dugger Lane, which point is at or near the Northwest (NW) Corner of the East Half (E ½) of Section 8, Township 7 South, Range 4 East; thence run South along the western boundary of the East Half (E ½) of said Section 8 to the Southwest (SW) Corner of said Half Section; thence continue to run South down the centerline of Shoots Lane to its intersection with Underwood Road, which point is at or near the Southwest (SW) Corner of the Northeast Quarter (NE ¼) of Section 17, Township 7 South, Range 4 East; thence continue to run South down the centerline of Cedar Street to its intersection with Azalea Avenue, which point is at or near the Southwest (SW) Corner of the Southeast Quarter (SE ¼) of Section 29, Township 7 South, Range 4 East; thence run East down the centerline of Azalea Avenue to its intersection with Juniper Street, which point is at or near the Southwest (SW) Corner of the Southeast Quarter (SE ¼) of Section 28, Township 7 South, Range 4 East; thence run North along the centerline of Juniper Street to its intersection with Pedigo Avenue; thence run East down the centerline of Pedigo Avenue to its intersection with Stuart Street; thence run North along the centerline of Stuart Street to its intersection with Myrtle Avenue; thence run East down the centerline of Myrtle Avenue to its intersection with Myrtle Court; thence run in a northerly and northeasterly direction down the centerline of Myrtle Court to its terminus, which point is in the Southeast Quarter (SE ¼) of Section 28, Township 7 South, Range 4 East; thence continue to run in a northeasterly direction down the common boundary line between Lots 8 and 9 of the Creek Side Estates Subdivision as recorded in Slides 1552-A and 1552-B, Baldwin County Probate Records, and continue to run in a straight line thereafter as needed to the northeast projection of said common Lot line to the centerline of a waterway known as Wolf Creek; which point is in the East Half (E ½) of said Section 28; thence run up the meandering centerline of Wolf Creek in a generally northwesterly direction to the point where Wolf Creek intersects with the western boundary of the Northeast Quarter (NE ¼) of Section 28, Township 7 South, Range 4 East; thence run North along the western boundary of the Northeast Quarter (NE ¼) of said Section 28 to Section Avenue, which point is at or near the Northwest (NW) Corner of the Northeast Quarter (NE ¼) of said Section 28; thence run North along the centerline of Juniper Street to its intersection with County Road 28, which point is at or near the Northwest (NW) Corner of the Northeast Quarter (NE ¼) of Section 9, Township 7 South, Range 4 East, and which is the Point of Beginning; LESS AND EXCEPT any land which is not in the corporate limits of the City of Foley.
Section 4: Methodology of Population Allocation by District
In order to obtain population by race for the City of Foley, the 2010 U.S. Census information was used. Upper and lower population limits were identified using the 5% deviation permitted by the U.S. Department of Justice. Continuity of annexed areas to existing districts was achieved when possible and for non-contiguous areas, population counts were utilized to determine into which district these should be included.
Section 5: Eligible Candidates and Electors
Candidates for election to City Council shall reside within the boundaries of the district for which they seek election, and shall continue to reside within the district they represent for the duration of their term as a member of the City Council. Only electors residing within a district shall be entitled to vote for candidates seeking election for said district.
Section 6: Adoption
