WHEREAS, pursuant to the Code of Alabama, 1975, Section 11-51-90 to 11-51-185, the City of Foley adopted Ordinance No. 1018-07 levying and assessing business license fees for doing any kind of business, trade, profession, or other activity in the municipality or its police jurisdiction, and;
WHEREAS, the City of Foley has need to expand the license fee schedule to include a schedule for "Places of Amusement/Entertainment";
NOW, THEREFORE, BE IT ORDAINED that the Foley City Council as follows:
Section 1. Amends Ordinance No. 1018-07, Section 27 (License Fee Schedules) as follows:
Schedule D (1) Places of Amusement or Entertainment
Places of amusement or entertainment, where the public is charged a fee to see, hear, attend, participate or engage in any kind of display, program, activity or event offered to include, but not be limited to: motion pictures; museums; zoos; skating rinks; amusement parks;
boat rides; sight-seeing tours for pleasure; hot air balloon rides; arcades; aquariums
Up to $50,000 $ 100.00
$ 50,001 - $200,000 $ 200.00
$200,001 - $300,000 $ 400.00
$300,001 - $500,000 $ 600.00
$500,001 - $700,000 $ 800.00
$700,001 - $800,000 $1,000.00
$800,001 - $1,000,000 $1,500.00
On gross revenues over $1,000,000 the fee shall be as stated above, PLUS $1.65 per thousand on gross sales or charges in excess of $1,000,000
Section 2. "The terms and provisions of this ordinance are severable. If any part or portion of this ordinance is declared invalid, void, or unconstitutional, that portion shall be deemed severed, and the remaining portions of the ordinance shall remain in full force and effect."
Section 3. All ordinances or parts of ordinances, in any manner conflicting herewith are hereby repealed.
Section 4. This ordinance shall become effective upon its publication as required by law.
