(First Reading) An Ordinance Amending Ordinance No. 1028-08 An Ordinance to Protect the Public Health, Safety, and Welfare by Providing Policies and Procedures For Usage At Public Parks Within The City of Foley

WHEREAS, the City deems it necessary to set standards rules and regulations for public parks, and

WHEREAS, The Parks & Recreation Department has reviewed and recommended this ordinance be amended.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY AT ITS MEETING ON THE 1ST DAY OF JULY 2024 AS FOLLOWS:

 

Section 1.                     It is expressly declared that the purpose of these regulations, policies and procedures is to provide a guideline for those people wishing to use Foley’s municipal parks.

This policy is applicable to all public parks listed below:

                     Sara Thompson Kids Park

                     Max Griffin Park

                     Mel Roberts Park

                     Aaronville Park

                     Beulah Heights Park

                     Heritage Park

                     John B. Foley Park

                     Foley Horse Arena

                     Florence B. Mathis Park

                     Pine Street Park

                     Raymond C. Christensen Sportsplex

                     Ralph Schumacher Soccer Park

                     Wilbourne Antique Rose Trail

                     Foley Dog Park

All users are responsible for adhering to and complying with all rules and regulations pertaining to usage at the City Parks. Any violation may result in removal and suspension or expulsion from the City Park, as well as other penalties. The rules and regulations are made a part of this ordinance upon its adoption.

RULES FOR GENERAL PARK USAGE

The City of Foley Park Facilities are for the public's enjoyment, relaxation, and family fun.  Anyone disobeying park rules will be asked to leave by city authorities and the city reserves the right to take more formal action if necessary.

Park Hours

All parks are open from 5 am to 10 pm.  No person shall be in any public park, trail, or playground in the City of Foley between 10 pm and 5 am with the following exceptions:

a.                     City of Foley programs or events may be held outside of open hours when approved by the Parks and Recreation Department.

b.                     Anyone attending a scheduled event may be in the park or playground beyond the closing time if the event has been approved by the City of Foley.

Tennis Court Rules

                     One-hour time limit, while other are waiting.

                     Tennis lessons and school matches take priority on all courts.

                     Tennis shoes are the only shoes allowed on the courts.

                     No skateboards, bicycles, or other wheeled objects on courts.

                     No profanity, abusive behavior or racket throwing.

                     No glass bottles are allowed on the premises.

                     Do not sit or lean on nets.

                     Tennis courts are for playing tennis only.  (No baseballs/softballs inside fence)

                     Please place all trash in receptacles.

                     Please turn off lights when you leave.

                     Adult supervision of all children is required at all times.

                     All participants and spectators are expected to be on their best behavior at all times.

                     All participants and spectators assume all risk of injury, damage or loss sustained on premises.

                     Proper conduct is expected.  Participants and spectators not complying will be asked to leave and the City of Foley reserves the right to take more formal action if necessary.

Sara Thompson Kids Park

                     Children under 12 must be accompanied by an adult.

                     Use equipment as it was intended. 

                     Review all warning labels before using any equipment.

                     One person per swing.  Stand clear of moving swings to avoid injury.  Slide feet first only.

                     Profanity and rough play is not allowed.

                     No loitering or solicitation.

                     No pets or animals.

                     No glass containers allowed.

                     No alcohol, smoking, vaping, or tobacco use.

                     No skateboards, bikes, or rollerblades.

                     No food or drink except in pavilion.

                     Use of the pavilion is on a first come, first serve basis.

                     No climbing or jumping on fences.

                     Defacing and damaging the equipment or property is punishable by law.

                     Wear shoes at all times.  Fully enclosed, rubber soled shoes are highly recommended.

                     Be careful of hot playing surfaces.

                     Do not climb on roofs, railings, posts, or on top of crawl tubes or tube slides.

                     Please clean up after yourself.

                     In case of emergency, call 911.

                     Any violations of the above rules may result in suspension or permanent ban from the park.

Aaronville Park Rules

                     Use equipment as it was intended.

                     The playground is designed for children two to twelve years, with adult supervision recommended.  Parents must be aware that all play is at their own risk!

                     Children must play with care and consideration for others.

                     Profanity and rough play in not allowed.

                     No loitering or solicitation.

                     No pets or animals.

                     No glass containers allowed.

                     No alcohol, smoking, or tobacco use.

                     No skateboards, bikes, or rollerblades.

                     No food or drink except in pavilion.

                     No climbing or jumping on fences.

                     Defacing and damaging the equipment or property is punishable by law.

Mel Roberts Park - Cypress Pond

                     Protect the wildlife by staying clear of animals which inhabit the park.

                     Put all trash in the receptacles provided.

                     No alcohol, tobacco, drugs, fireworks, or profanity is allowed.

                     No glass containers allowed.

                     No vehicles allowed on walking trails, grass or by the pavilion.

                     No fishing, swimming, or boating in the pond.

                     Dogs must be kept out of the playground area and off the athletic fields.

                     You must clean up after your dog.

                     No soliciting of any kind shall be allowed.

                     Visitors not complying with rules will be asked to leave and the City of Foley reserves the right to take more formal action if necessary.

Municipal Pool Rules - Aaronville and Max Griffin

                     You must obey the lifeguards.

                     Swim suits are required to swim.

                     Everyone must sign-in.

                     No noodles or floats (only floats with bottoms for babies are allowed).

                     Food and drinks are only allowed under the covered areas.  No sunflower seeds.

                     No glass bottles.

                     No running or horseplay.

                     No fighting or using foul language.

                     Do not swim if you are sick or have eaten in the last 30 minutes.

                     If your child is not potty trained, he or she must wear a swim diaper or swim pants.

                     You must be able to swim across the deep end without a floatation device to jump off the diving board.

                     You are not allowed to jump off the diving boards with a floatation device.

                     Pool will be closed during lightning or threatening weather.

                     Lifeguards are not responsible for lost or stolen personal belongings.

                     Anyone under the age of 12 must be accompanied by someone 16 years old or older.

                     Pool Managers shall have the authority to restrict admission until such time as overcrowded conditions are relieved.

                     Patrons not complying with rules will be asked to leave and the City of Foley reserves the right to take more formal action if necessary.

 

Section 2.                     "The terms and provisions of this ordinance are severable.  If any part or portion of this ordinance is declared invalid, void, or unconstitutional, that portion shall be deemed severed, and the remaining portions of the ordinance shall remain in full force and effect."

Section 3.                     All ordinances or parts of ordinances, in any manner conflicting herewith are hereby repealed.

Section 4.                     This ordinance shall become effective upon its publication as required by law.
