The City currently provides sanitation services and yard debris removal in addition to fire and police services to gated communities/private roads within the City limits on a regular basis. It has been determined that the City should also collect and remove disaster debris from the curbside of these gated communities and private roads because it is in the best public interest of these communities to eliminate threats to life and public health and safety, and to ensure the economic recovery of the affected communities to the benefit of the communities at large.  The City will be required to request FEMA approval for the funding of curbside debris removal from private roads and gated communities.  This resolution documents the City's legal authority to collect and remove disaster debris from these gated communities and private roads.

     WHEREAS, on September 16, 2020, the City of Foley along with other communities in the State of Alabama were severely impacted by Hurricane Sally, and,

     WHEREAS, President Donald Trump issued a major disaster declaration on September 20, 2020, and,

     WHEREAS, Hurricane Sally has created widespread disaster debris throughout the City of Foley which poses a significant and immediate threat to the health, safety and welfare of City of Foley residents and the public at large, and,

     WHEREAS, the City currently provides sanitation services and yard debris removal in addition to fire and police services to gated communities/private roads within the City limits on a regular basis. 

     NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:

     SECTION 1:     Determines that the widespread debris throughout the community constitutes a hazardous environment for all modes of transportation of the residents as well as emergency aid and relief services, poses endangerment to properties and creates an environment conducive  to disease, vermin and increased risk of fire.

     SECTION 2:     Determines that it is in the public interest to collect and remove disaster debris from all public roads and properties within the City of Foley, including private roads and gated communities to eliminate the threat to life, public health and safety and to reduce the threat of additional damage to improved property and to promote the economic recovery of the City of Foley and the community at large.

     SECTION 3:     The City of Foley is hereby directed to collect and remove disaster debris from the curbside of private roads and gated communities throughout the City limits as necessary to eliminate the immediate threat to the life, public health and safety of residents and to eliminate the further threat of damage to improved property and promote the economic recovery of the City of Foley and the community at large.

     SECTION 4:     This Resolution shall become effective immediately upon its adoption as required by law.
