AN ORDINANCE TO REZONE 84+/- ACRES FROM A-O (Agricultural Open Space) TO R-3 (Local Business District). Mr. Foley requested R-3, Residential Multi-Family zoning but the Planning Commission's recommendation came back as B-3 Local Business District.  Mr. Foley is aware of the change.
 
 
 
Body
WHEREAS, the City of Foley, Alabama adopted Ordinance No. 387-87 on July 15, 1987, ordaining a Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and
WHEREAS, the City of Foley has received a request that specific property within the City be rezoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals, and general welfare of the City to amend said Ordinance, and
WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met.
 
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA while in regular session, as follows:
Section 1.  That the official Zoning Map of the City of Foley, Alabama be amended to rezone the portion of property previously zoned A-O (Agricultural Open Space) to B-3(Local Business District); said property description as follows:

Commencing at the Southeast corner of the Northwest Quarter of Section 21, Township 7 South, Range 4 East, Baldwin County, Alabama; thence run West 30 feet, more or less, to a point; thence run North 15 feet, more or less, to a point where the Western Right-of-Way boundary of N Juniper St and the unused Northern Right-of-Way boundary of E Fern Av converge, which is also the Point of Beginning;  thence run North 560 feet, more or less, along the Western Right-of-Way boundary of N Juniper St to a point; thence run West 1291 feet, more or less, to a point on the Eastern Right-of-Way boundary of an unused road; thence run South 560 feet, more or less, along the Eastern edge of said unused Right-of-Way to a point that converges with the Northern Right-of-Way boundary of E Fern Av ; thence run East along said Right-of-Way boundary 1291 feet, more or less, to the Point of Beginning, said tract of land containing 16.5 acres, more or less.

      Section 2.  That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.
