     WHEREAS, on June 2, 2015, Governor Robert Bentley signed Act 2015-293, giving governments more flexibility to award bids to responsible local vendors, and,

     WHEREAS, the law became effective on September 1, 2015, and,

     WHEREAS, under the new law, counties and municipalities can award bids to local vendors if that company's submission is within 5 percent of a lower bid from a merchant based outside the area, and,

     WHEREAS, local governments can also award contracts to a local vendor if that company's submission is within 10 percent of a lower bid from outside the state, and,

    

     NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:

     SECTION 1:     Accepts the new guidelines established in Act 2015-293 and allows these guidelines to be utilized when appropriate, on a case by case basis.

     SECTION 2:     Defines the local preference area to be within the police jurisdiction of the City of Foley.

     SECTION 3:     Incorporates this resolution into and as apart of the City's Purchasing Policy.                     

     SECTION 4:     This Resolution shall become effective immediately upon its adoption as required by law.
