OWA and Brock Beal are in agreement to offer various helicopter tours to the public from an OWA location that will be determined.  They are in the process of getting approval from the Navy for their base location.  Because it could take up to 90 days to get approval and then construct a helipad, it is the desire of OWA and Brock Beal to operate temporarily from the Foley Municipal Airport for a period not to exceed 90 days.  A fee would be negotiated and approved by the Mayor.

     WHEREAS, Brock Beal is the owner and operator of a helicopter that is based at the Foley Municipal Airport.  He is working with OWA to offer various helicopter tours to the public from a location to be determined at OWA.

     WHEREAS, Brock Beal and OWA are currently working with the Navy to approve the base location for these operations and once approved, a helipad will be constructed on OWA property.  It is anticipated that location approval and construction of the helipad may take up to 90 days.

     WHEREAS, it would be ideal if operations could begin in the near future and be available during tourist season; therefore, it is requested that permission be granted for operations to be performed at the Foley Municipal Airport on a temporary basis.

     WHEREAS, compensation for operations at the Foley Municipal Airport will be negotiated by all parties involved.

     NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:

     SECTION 1:     Grants permission for fixed based operations to be performed on a temporary basis at the Foley Municipal Airport, not to exceed 90 days unless permission for an extension is granted.

     SECTION 2:     Grants authority to the Airport Manager and Mayor to negotiate and execute the required agreements. 

     SECTION 3:     This Resolution shall become effective immediately upon its adoption as required by law.
