ORDINANCE AMENDING ORDINANCE NO. 387-87 REZONING PROPERTY OWNED BY JONATHAN BYRD FROM B1A TO PUD
 
Body
WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and
 
WHEREAS, the City of Foley has received a request that specific property within the City be re-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and
 
WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met.
 
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, while in regular session (Insert date presented to Council for First Reading) as follows:
 
Section 1.      That the official Zoning Map of the City of Foley, Alabama be amended to rezone the portion of property previously zoned B1A, Extended Business District to PUD, Planned Unit Development; said property description as follows:
 
Tax Map No. 05-61-02-10-0-000-002.003, PIN No. 347678
 
PARCEL A:  Lot 1-B of the Resubdivision of Lot 1 Foley Crossroads Subdivision, as recorded on Slide 2483C, Probate records, Baldwin County, AL.
 
      LESS & EXCEPT ANY PORTION OF PARCEL A WHICH LIES WITHIN THE FOLLOWING:
Commence at the Northwest Corner of the Northeast Quarter of Section 10, Township 8 South, Range 4 East, Baldwin County, Alabama; run thence South for 40.00 feet to the south right-of-way of Baldwin County Road No. 20 (AKA Miflin Road) for the Point of Beginning; run thence North 89 degrees, 41' 04" East along the South right-of-way line of said Baldwin County Road No. 20 for 1349.31 feet; run thence South 00 degrees 34' 31" West for 20.00 feet; run thence South 89 degrees 41' 04" seconds West for 1349.38 feet; run thence North 00 degrees 47' 16" East for 20.00 feet to the South right-of-way of said Baldwin County Road 20 and the Point of Beginning.       
      LESS & EXCEPT ANY PORTION OF PARCEL A WHICH LIES WITHIN THE FOLLOWING:
Commence at the Northwest corner of the East one-half of the Northwest Quarter of Section 10, Township 8 South, Range 4 East, Baldwin County       Alabama; run thence South for 40.00 feet to the South right-of-way of Badlwin County Road No. 20 (AKA Miflin Road) for the Point of Beginning; run thence North 89 degrees 44' 09" East along the South right-of-way line of said Baldwin County Road No. 20 for 1366.59 feet; run thence South 00 degrees 47' 16" West for 20.00 feet; run thence South 89 degrees 44' 09" West for 1366.29 feet; run thence North 00 degrees 05' 20" West for 20.00 feet to the South right-of-way of said Baldwin County Road No. 20 and the Point of Beginning.
      LESS & EXCEPT ANY PORTION OF PARCEL A WHICH LIES WITHIN THE FOLLOWING:
Commence at the Northwest corner of the Northeast Quarter of the Northeast Quarter Section 10, Township 8 South, Range 4 East, Baldwin County, Alabama; run thence South 00 degrees 06' 23" West for 40.00 feet to the South right-of-way of Baldwin County Road No. 20 (AKA Miflin Road) for the Point of Beginning; run thence South 90 degrees 00' 00" East along the South right-of-way line of said Baldwin County Road No. 20 for 5.00 feet; run thence South 00 degrees 31' 53" West for 21.48 feet; run thence South 89 degrees 32' 58" West for 5.02 feet; run thence North 00 degrees 34' 31" East for 21.52 feet to the South right-of-way of said Baldwin County Road No. 20 and the Point of Beginning.

SECTION 2.      That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.
 
SECTION 3:       This Resolution shall become effective immediately upon its adoption as required by law.
