Body
WHEREAS, BC Foley, the City of Foley, and the Public Athletic and Sports Facilities Cooperative District all own portions of land commonly known as the BC Master Parcel, Pride Drive Parcel, Sports East Parcel and Easement Area, and
WHEREAS, the City of Foley and the Sports District desire a nonexclusive access and utility easement over approximately 12,507.64 square feet of the BC Master Parcel that abuts a part of Pride Drive, which is referenced as the "Easement Area" in the "Access and Utilitiy Easement Agreement", and
WHEREAS, the City agrees to a 30 foot wide commercial curb cut and relocating a City Party curb cut and the parties wish to document their full understanding and agreement concerning the access and utility easements, rights, and benefits in the form of an agreement.
NOW THEREFORE BE IT RESOLVED that the Public Athletic and Sports Facilities Cooperative District of the City of Foley, Alabama, as follows:
SECTION 1: Approves the attached "Access and Utility Easement Agreement" in its entirety and is made a permanent part of this resolution upon its adoption setting forth each parties full understanding and agreement concerning the access and utility easements, rights, and benefits in the form of this Agreement.
SECTION 2: Authorizes the Chairman to enter into an "Access and Utility Easement Agreement" to set forth a full understanding concerning the access and utility easements, rights and benefits between the City of Foley, BC Foley and the City of Foley's Public Athletic and Sports Facilities Cooperative District.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
