SOURCE OF FUNDING:
The cost breakdown is 3.38 acre easements at $10,000.00 per acre, totaling $33,800.00 for these easements; and, a two (2) acre parcel at $20,000.00 per acre, totaling $40,000.00.  These two amounts equal to sale amount of $73,800.00 under account 01-5910.

      WHEREAS, a parcel located on Bender Road and described as Lot 1 of the Foley Beach Express West Industrial Park, Phase I is to be sold to the Utilities Board of the City of Foley, Alabama, as an easement, and
 
      WHEREAS, the  cost breakdown is 3.38 acre easements at $10,000.00 per acre, totaling $33,800.00 for these easements; and, a two (2) acre parcel at $20,000.00 per acre, totaling $40,000.00.  These two amounts equal to sale amount of $73,800.00
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
      SECTION 1:  It is hereby found, established and declared that 2 acres of real property owned by the City of Foley, Alabama, which is described below, is no longer needed for public or municipal purposes, to wit:
      
      Lot 1, Foley Beach Express West Industrial Park, Phase I
 
      SECTION 2:  It is hereby found, established and declared that the Utilities Board of the City of Foley, Alabama, which desires to acquire said real property for the purposes of an utilities easement, will serve a public purpose and will serve the best interests of the public and the City of Foley by serving its citizens with needed utilities.
 
      SECTION 3:      It is hereby found, established and declared to be in the best interest of the public and the City of Foley, Alabama to transfer and convey said real property to the Utiliites Board of the City of Foley, Alabama in consideration of SEVENTY-THREE THOUSAND EIGHT HUNDRED AND NO/100 DOLLARS ($73,800.00) under Account 01-5910.
 
      SECTION 4:      That, pursuant to the authority granted by Section 11-47-20, Code of Alabama, the Mayor and the City Clerk are hereby authorized and directed to execute and attest a deed conveying title to said property to the Utilities Board of the City of Foley, Alabama, which deed is to be prepared  and reviewed by legal counsel, upon such terms and conditions as the Mayor and legal counsel deem appropriate, and to make any and all other action they deem necessary or prudent to effectuate the transfer of title of said property to the Utilities Board of the CIty of Foley, Alabama.
 
      SECTION 5:      This ordinance shall become effective immediately upon its adoption and publication as required by law.
