(Second Reading) ORDINANCE AMENDING ORDINANCE NO. 387-87 REZONING PROPERTY OWNED BY SOUTH BALDWIN HEALTH CARE AUTHORITY AND SOUTH BALDWIN HOSPITAL BOARD FROM PUD, R1A & B1A TO PO

 

 

Body

                     WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a new Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and

 

                     WHEREAS, the Planning Commission has recommended approval of this rezoning, and

                     WHEREAS, the City of Foley has received a request that specific property within the City be re-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and

                     WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met,

                     NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA while in regular session accepted the following changes:

Section 1.                     That the official Zoning Map of the City of Foley, Alabama be amended to rezone the portion of property previously zoned PUD - Planned Unit Development, R1A - Residential Single Family and B1A - Extended Business District to PO - Preferred Office District said property description as follows:

Baldwin County, Alabama

Portion of Parcel 54-04-20-1-000-005.000 (PPIN 039785)

All of Parcel 54-04-20-1-000-006.003 (PPIN 216764)

Beginning at a Point where the North line of Lot 39 of Kuhn’s Park Addition to the Town of Foley, being a subdivision of the Southeast Quarter of the Northeast Quarter of Section 20, Township 7 South, Range 4 East, as recorded in the Office of the Judge of Probate, Baldwin County, Alabama, in Map Book 3, Page 11, intersects the East right of way line of N Alston Street;

Thence along the North line of said Lot 39, North 89°49’50” East for a distance of 340.42 feet; Thence South 0°09’30” West for a distance of 289.05 feet;

Thence South 89°32’34” West for a distance of 38.94 feet; Thence South 1°43’22” West for a distance of 10.28 feet;

Thence South 0°01’47” East for a distance of 200.96 feet to the South Line of lot 31 of Kuhn’s Park Addition to the Town of Foley, being a subdivision of the Southeast Quarter of the Northeast Quarter of Section 20, Township 7 South, Range 4 East, as recorded in the Office of the Judge of Probate, Baldwin County, Alabama, in Map Book 3, Page 11;

Thence along the South line of said Lot 31, South 89°32’45” West for a distance of 301.27 feet to the Southwest corner of said Lot 31 in the East right of way line of N Alston Street;

Thence along said right of way line, North 0°40’33” East for a distance of 201.25 feet; Thence continuing with said right of way, North 0°33’33” West for a distance of 161.00 feet;

Thence continuing with the East right of way line of N Alston Street, North 0°00’27” West for a distance of 139.75 feet to the Point of Beginning.

Containing 3.715 Acres, more or less.

 

SECTION 2: That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.

 

SECTION 3:  This Ordinance shall become effective immediately upon its adoption as required by law.
