ORDINANCE AMENDING ORDINANCE NO. 387-87 REZONING PROPERTY

OWNED BY MAGNOLIA LANDING LLC FROM B2 - NEIGHBORHOOD BUSINESS DISTRICT AND R1D - RESIDENTIAL SINGLE FAMILY

TO PUD - PLANNED UNIT DEVELOPMENT

 

                     WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a new Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and

 

                     WHEREAS, the Planning Commission has recommended approval of this rezoning, and

                     WHEREAS, the City of Foley has received a request that specific property within the City be re-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and

                     WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met,

                     NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA while in regular session accepted the following changes:

Section 1.                     That the official Zoning Map of the City of Foley, Alabama be amended to rezone the portion of property previously zoned B2 - Neighborhood Business District and R1D - Residential Single Family to PUD - Planned Unit Development said property description as follows:

 

LEGAL DESCRIPTION:

LOT 2 MAGNOLIA LANDING, FOLEY, ALABAMA:

COMMENCING AT THE SOUTHEAST CORNER OF SECTION 7, TOWNSHIP 8 SOUTH, RANGE 4 EAST, BALDWIN COUNTY, ALABAMA; THENCE NORTH 00°14'35" WEST A DISTANCE OF 397.45 FEET TO A POINT; THENCE NORTH 89°48'01" WEST A DISTANCE OF 40.00 FEET TO A POINT MARKED BY A CAPPED IRON ROD (REBAR) ON THE WEST MARGIN OF THE RIGHT OF WAY OF HICKORY STREET SOUTH, SAID POINT BEING THE SOUTHEAST CORNER OF LOT 1, MAGNOLIA LANDING, AS RECORDED ON SLIDE 2667-A IN THE OFFICE OF THE JUDGE OF PROBATE, BALDWIN COUNTY, ALABAMA, THENCE ALONG THE EAST LINE OF SAID LOT 1 AND THE WEST MARGIN OF SAID HICKORY STREET, NORTH 00°14'35" WEST A DISTANCE OF 936.27 FEET TO A POINT MARKED BY A CAPPED IRON ROD (REBAR), SAID POINT BEING THE NORTHEAST CORNER OF SAID LOT 1 AND THE POINT OF BEGINNING OF THE PROPERTY HEREIN DESCRIBED; THENCE CONTINUE NORTH 00°14'35" WEST A DISTANCE OF 651.97 FEET TO A POINT MARKED BY A CAPPED IRON ROD (REBAR); THENCE DEPARTING SAID WEST MARGIN NORTH 89°36'34" WEST A DISTANCE OF 1,296.92 FEET TO A POINT MARKED BY AN IRON ROD (REBAR); THENCE SOUTH 00°06'37" EAST A DISTANCE OF 651.65 FEET TO A POINT MARKED BY A CAPPED IRON ROD (REBAR); THENCE SOUTH 89°35'46" EAST A DISTANCE OF 1,298.43 FEET TO THE POINT OF BEGINNING AND CONTAINING 845,792 SQUARE FEET, (19.42 ACRES), MORE OR LESS.

SUBJECT TO A 60' ACCESS EASEMENT DESCRIBED AS:

SECTION 2: That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.

 

SECTION 3:  This Ordinance shall become effective immediately upon its adoption as required by law.
