Tommy Rachel has agreed to the terms set forth in the attached Performance Contract. This contract is for a term of five (5) years. The cost of $60,000 immediately for advertising rights on a new ballon plus $10,000 per year for a total cost over a five year period of $110,000. The 2015 budget included $15,000 so an appropriation of $45,000 would need to be included in the resolution if this contract is approved. The $60K would go towards the cost of a new balloon, which he will order. The payment is for advertising rights on the side of the new balloon, which will be in the City's colors with the City's logo. The price of the balloon increases by 10% effective November 1st.
He has agreed to attend the Gonzalas and Natchez Hot Air Balloon Festivals each year to market the City of Foley; to provide the City with two glows annually at no cost to the City and the local events will be at the City's discretion; and attending and participating as Balloon Meister at the local annual balloon festival in the City of Foley.

WHEREAS, the Foley City Council has deemed entering into a Performance Contract with Taking Off Hot Air Balloon Co. a good and useful purpose of public funds in order to market the City of Foley to increase tourism and to stimulate the economy.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Appropriates an additional $45,000 to Tommy Rachel's contract and amends Account No. 01-620-3210 Contracts for Public Service.
SECTION 2: Authorizes the Mayor to enter into the five year Performance Contract with Taking Off Hot Air Balloon Co. as set forth in the attachment, which is made a permanent part of this Resolution upon its adoption.
SECTION 3: This Resolution shall become effective immediately upon its adoption as required by law.
