Habitat For Humanity has not developed the property as stated in the Ground Lease that was signed on November 8, 2004, therefore Resolution 2323-04 must be rescinded.

WHEREAS,on April 5, 2004, Council adopted Resolution 2323-04 Authorizing Land Lease To Habitat For Humanity of Baldwin County for approximately 1.79 +/- acres of land running along the north side of a drainage ditch on the west side of North Juniper Street and south of East Section Avenue, and
WHEREAS, Habitat For Humanity has not developed the property as stated in the Ground Lease that was signed on November 8, 2004, therefore Resolution 2323-04 must be rescinded.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: Rescinds Resolution 2323-04 Authorizing Land Lease To Habitat For Humanity of Baldwin County
SECTION 2: This Resolution shall become effective immediately upon its adoption as required by law.
