ORDINANCE AMENDING ORDINANCE NO. 387-87 REZONING PROPERTY OWNED BY PARADISE CREEK LLC/DR. TODD EDMISTON FROM MH1 - MOBILE/MANUFACTURED DWELLING PARK TO B-1A EXTENDED BUSINESS DISTRICT

 

Body

WHEREAS, the City of Foley, Alabama, adopted Ordinance No. 387-87 on June 15, 1987, ordaining a Zoning Ordinance and Zoning Map for the City of Foley which has subsequently been amended, and

 

WHEREAS, the City of Foley has received a request that specific property within the City be re-zoned, and the City Council of the City of Foley deems it necessary, for the purpose of promoting the health, safety, morals and general welfare of the City to amend said Ordinance, and

 

WHEREAS, all requirements to the laws of the State of Alabama, with regard to the preparation of the report of the Foley Planning Commission and subsequent action of the City Council have been met.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, while in regular session (Insert date presented to Council for First Reading) as follows:

 

Section 1.                     That the official Zoning Map of the City of Foley, Alabama be amended to rezone the portion of property previously zoned MH-1, Mobile/Manufactured Dwelling Park  to B1A, Extended Business District; said property description as follows:

 

Tax Map No. 05-61-02-04-0-000-009.000, PIN No. 082803

PARCEL Commencing at the Southeast corner of the Northwest Quarter of the Southeast

Quarter of Section 4, Township 8 South, Range 4 East, Baldwin County,

Alabama; run thence North 00° 04' 45" East, along the East boundary of said

Northwest Quarter of the Southeast Quarter, a distance of 326.02 feet to an iron

pin for the point of beginning; thence run South 89° 51' 43" West, a distance of

1286.35 feet to an iron pin lying on the present East right of way line of Juniper

Street; thence run North 00° 03' 05" East, along said East right of way line, a

distance of 326.00 feet to an iron pin; thence run North 89° 51' 43" East, a distance

of 1286.77 feet to an iron pin lying on said East boundary; thence run South

00° 04' 45" West, along said East boundary, a distance of 326.07 feet to the point of

beginning; SUBJECT TO an apparent 40 foot right of way easement over and

across the Eastern end thereof.

LESS AND EXCEPT such oil. gas, and other mineral interests and all rights and privileges in connection therewith as may have been reserved or conveyed by prior owners, if any, and as recorded in the Baldwin County, Alabama Judge of Probate's Office under Instrument number 1587898.

 

SECTION 2.                     That the official Zoning Map of the City of Foley be revised to indicate this amendment and duly certified by the appropriate municipal officials.

 

SECTION 3.     The rezoning is contingent upon the removal of all mobile homes from the property.

 

SECTION 4:                      This Ordinance shall become effective immediately upon its adoption as required by law.
