Body
      WHEREAS, on the 8th day of July, 2013, BC Foley, LLC, being the owner(s) of all the real property hereinafter described, did file with the City Clerk a petition asking that the said tracts or parcels of land be annexed to and become a part of the City of Foley, and
 
      WHEREAS, said petition did contain the signatures of all the owners of the described territory and a map of said property showing its relationship to the corporate limits of the City of Foley, and
 
      WHEREAS, the governing body did determine that it is in the public interest that said property be annexed to the City of Foley and it did further determine that all legal requirements for annexing said real property have been met pursuant to Sections 11-42-20 through 11-42-24, Code of Alabama, 1975;
 
      NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF FOLEY, ALABAMA, AS FOLLOWS:
 
      Section 1.      The Council of the City of Foley, Alabama, finds and declares as the legislative body of the City that it is in the best interests of the citizens of the City, and the citizens of the affected area, to bring the territory described in Section 2 of this ordinance into the City of Foley.
 
      Section 2.      The boundary lines of the City of Foley, Alabama, be, and the same are hereby altered or rearranged so as to include all of the territory heretobefore encompassed by the corporate limits of the City of Foley, Alabama, and in addition thereto the following described territory, to-wit:
 
Tax Map PIN #  89331 (9.4 Acs), 40018 (28 Acs), 83386 (39 Acs), 48909 (121 Acs), 3790 (14.65Acs), 62539 (20.17Acs).
 
Parcel 1: PIN 48909 The Northwest Quarter of the Northwest Quarter; AND the Southwest Quarter of the Northwest Quarter; AND the Southeast Quarter of the Northwest Quarter, all in Section 3, Township 8 South, Range 4 East, Baldwin County, Alabama.
 
Parcel 2: PIN 40018 Commence at a railroad spike found at the "locally accepted" Southeast corner of Section 4, Township 8 South, Range 4 East, Saint Stephens Meridian; thence run South 89 degrees 41 minutes 09 seconds West along the South line of said Section 4, a distance of 2668.36 feet to the Southwest corner of the Southeast Quarter of said Section 4; thence run North 00 degrees 19 minutes 18 seconds West, 2985.61 feet to a capped iron pin marker being the Point of Beginning; thence run North 89 degrees 37 minutes 13 seconds East, 1335.93 feet to a capped iron pin marker; thence run North 00 degrees 17 minutes 17 seconds West, 1004.43 feet to a capped iron pin marker at the Northeast corner of the Southwest Quarter of the Northeast Quarter of said Section 4; thence run South 89 degrees 35 minutes 16 seconds West, 1336.51 feet to a capped iron pin marker at the Northwest corner of the Southwest Quarter of the Northeast Quarter of said Section 4; thence run South 00 degrees 19 minutes 18 seconds East, 1003.67 feet to the Point of Beginning.
 
Parcel 3: PIN 83386  The Southeast Quarter of the Northeast Quarter of Section 4, Township 8 South, Range 4 East, Baldwin County, Alabama.
 
Parcel 4: PIN 89331 Commence at a railroad spike found at the "locally accepted" Southeast corner of Section 4, Township 8 South, Range 4 East, Saint Stephens Meridian; thence run South 89 degrees 41 minutes 09 seconds West along the South line of said Section 4, a distance of 2668.36 feet to the Southwest corner of the Southeast Quarter of said Section 4; thence run North 00 degrees 19 minutes 18 seconds West, 2659.52 feet to a capped iron pin marker at the Southwest corner of the Southwest Quarter of the Northeast Quarter of said Section 4 being the Point of Beginning; thence run North 89 degrees 37 minutes 13 seconds East, 1335.74 feet to a capped iron pin marker at the Southeast corner of the Southwest Quarter of the Northeast Quarter of said Section 4; thence run North 00 degrees 17 minutes 17 seconds West, 326.09 feet to a capped iron pin marker; thence run South 89 degrees 37 minutes 13 seconds West, 1335.93 feet to a capped iron pin marker; thence run South 00 degrees 19 minutes 18 seconds East, 326.09 feet to the Point of Beginning.
 
Parcel 5: PIN 62539 The East One-half (E1/2) of the Northeast Quarter (NE1/4) of the Southeast Quarter (SE1/4) of Section Four (4) in Township Eight (8) South, Range Four (4) East, Baldwin County, Alabama.
 
Parcel 6: PIN 3790 From the Northwest corner of the East Half of the Southeast Quarter of the Southeast Quarter of Section 4, Township 8 South, Range 4 East, run thence East 129 feet to the Point of Beginning; continue thence East to the Northeast corner of said Southeast Quarter of the Southeast Quarter 521 feet; run thence South 1,320 feet, more or less, to the Southeast corner of said Southeast Quarter of Southeast Quarter; run thence West 531 feet, more or less, to a pont which is 129 feet East of the Southwest corner of the East half of the Southeast Quarter of the Southeast Quarter of said Section 4; run thence North 1320 feet, more or less, to the Point of Beginning.  SAVE AND EXCEPT right of way for roadway.
 
      Section 3.      At the time of annexation Petitioners are requesting PUD, Planned Unit Development zoning.  The parcels will be annexed unzoned and Petitioners will go before Planning Commission to finalize the zoning.
 
      Section 4.      This ordinance shall be published as provided by law, and a certified copy of same, together with a certified copy of the petition of the property owners, shall be filed with the Probate Judge of Baldwin County, Alabama.
      
      Section 5.      The territory described in this ordinance shall become a part of the corporate limits of Foley, Alabama, upon publication of this ordinance as required by law.
