     WHEREAS,  Baldwin County Commission and the City of Foley are authorized under Alabama law to control, manage, supervise, repair, maintain and improve certain public roads inside their respective jurisdiction, and

 

    WHEREAS,  the County and the City acknowledge and agree that an extension of James Road south of its current end at the Brinks Willis Road intersection would involve participation from both governmental parties, and

 

     WHEREAS,  the County and the City acknowledge and agree that due to substantial population growth and the increase traffic, extending James Road from Brinks Willis Road to the Gulf Shores city limits would benefit the traveling public, and

 

     WHEREAS,  the County and City now wish to enter into this Agreement to provide for joint cooperation to extend James Road from its current end at the Brinks Willis Road intersection southward to connect to the newly-constructed Oak Road East at the Gulf Shores city limits as part of the 30 Cubed program.

 

     NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:

 

     SECTION 1:     Approves the Intergovernmental Agreement for the James Road Extension between Brinks Willis Road and Oak Road East project and authorizes the Mayor to execute said agreement.

 

     SECTION 2:     This Resolution shall become effective immediately upon its adoption as required by law.
