DESCRIPTION OF TOPIC: (who, what, when, where, why, and how much)Engineering and Environmental Departments would like to request consideration of a new Technical Design Manual (TDM) Ordinance to replace the previous Land Development Permit and Traffic Impact Ordinances. This rewrite is a more organized version of the previously utilized Land Development Ordinance.

WHEREAS, the City of Foley, Alabama is authorized to regulate development, land disturbance, construction standards, environmental protections, and related engineering requirements within its jurisdiction; and
WHEREAS, the City has previously adopted various ordinances addressing land development permits, erosion and sediment control, shoreline construction, traffic impact studies, environmental permitting, and construction design standards; and
WHEREAS, the Environmental and Engineering Departments have prepared a Technical Design Manual (TDM) to consolidate, modernize, and organize the Land Development Permit Ordinance and the Traffic Impact Ordinance, standards into a single comprehensive ordinance; and
WHEREAS, the Foley City Council finds that adoption of the Technical Design Manual will improve development standards, administrative efficiency, and protection of public health, safety, welfare, and environmental resources within the City of Foley.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, AS FOLLOWS:
Section 1: The Technical Design Manual (TDM), attached hereto and incorporated herein by reference, is hereby adopted as the official engineering, development, permitting, and construction standard for the City of Foley, Alabama.
Section 2: The following ordinances, together with any amendments thereto, are hereby rescinded and superseded by this Ordinance and the Technical Design Manual adopted herein: Ordinance No. 371-86 Ordinance No. 993-07 Ordinance No. 1024-08 Ordinance No. 1025-08 Ordinance No. 15-1003 Ordinance No. 17-2039 Ordinance No. 19-2023 Ordinance No. 22-2028.
Section 3: The provisions of this Ordinance are declared to be severable. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the remaining portions of this Ordinance.
Section 4: This ordinance shall become effective upon its publication as required by law.
