WHEREAS, the City of Foley and the Baldwin County Board of Education entered into a Local Public School Support Agreement dated October 20, 2022, to provide financial support for public education within the City of Foley; and
WHEREAS, the parties desire to further amend the Agreement through the Third Amendment to the Local Public School Support Agreement; and
WHEREAS, the Third Amendment provides for an annual City contribution of $350,000 beginning with the school year 2026 - 2027, with the Baldwin County Board of Education providing a matching contribution; and
WHEREAS, the City Council finds that supporting public education serves a valid public purpose and promotes the educational interests of the citizens of Foley; and
WHEREAS, the budget needs to be increase to accommodate the increase to the support agreement: $50,000 to 100-1012-6111 Contracts for Public Services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FOLEY, ALABAMA, AS FOLLOWS:
Section 1: The City Council hereby approves the Third Amendment to the Local Public School Support Agreement between the City of Foley and the Baldwin County Board of Education in substantially the form presented to the Council.
Section 2: The Mayor is hereby authorized and directed to execute the Third Amendment and any related documents necessary to carry out the intent of this Resolution.
Section 3: The City shall appropriate and deliver annually to the Baldwin County Board of Education the sum of Three Hundred Fifty Thousand Dollars ($350,000).
Section 4: The City Clerk is authorized to attest the Mayor’s signature and to maintain the executed Amendment among the official records of the City.
Section 5: Amends the budget as requested to accommodate the increase to the support agreement: $50,000 to 100-1012-6111 Contracts for Public Services.
Section 6: This Resolution shall become effective immediately upon its adoption.
