WHEREAS, the City of Foley acknowledges that the Baldwin County Commission has applied for and received ATRIP funding to make intersection improvements at County Road 65 and Highway 98 intersection, and
WHEREAS, Baldwin County Commission has partnered with the City of Foley for improvements on County Road 20 between Alabama Highway 59 and South Hickory Street, and
WHEREAS, the City of Foley acknowledges that the proposed intersection improvements at the County Road 65 and Highway 98 will be a benefit to residents of the City, and
WHEREAS, the City of Foley is desirous of the intersection improvements project coming to complete fruition.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, as follows:
SECTION 1: The City agrees to pay one-half (½) of all approved overruns for said referenced intersection improvement project. The City further agrees and understands that all anticipated overruns must be approved by the Alabama Department of Transportation.
SECTION 2: The City further understands that any anticipated overruns, prior to being submitted to the Alabama Department of Transportation for approval, shall have the concurrence of the City of Foley through its Engineering Department.
SECTION 3: It is further understood that the ATRIP grant funds will fund all approved overruns at a rate of eighty-percent (80%), with twenty-percent (20%) being the responsibility of the Baldwin County Commission and City of Foley. The City and County agree to mutually split the referenced twenty-percent (20%) portion of approved overruns.
SECTION 4: This Resolution shall become effective immediately upon its adoption as required by law.
