In April 2004, Mr. Shane Ratcliff, and at that time the owner of Azalea Avenue Self Storage, donated a 20' unimproved right of way to the City so that owners of four parcels could have ingress/egress to their property. The owners, 761 South McKenzie, LLC, of parcel 05-54-08-33-2-000-007.004 wants to donate 8' strip of land to the City of Foley so that larger trucks will be able to more easily make the turn into the back of that parcel. The land is located north of Reynolds Ace Hardware, in between Parcel #05-54-08-33-2-000-007.004 and Parcel #05-54-08-33-2-000-007.001. See Plat for exact location.

WHEREAS, during a regularly scheduled Council meeting of April 19, 2004 the City Council accepted a 20' unimproved easement running between several businesses that this easement was designated to be an ingress/egress easement for four lots for the resubdivision of Lot 1 of DNY Subdivision, and
WHEREAS, 761 South McKenzie, LLC wants to donate an 8' piece of land to the City of Foley so that the larger trucks will have better ingress/egress through the un-nammmed asphalt street between Lots 1 and 4; more particularly described as follows:
A portion of Lot 1 of the Re-subdivision of Lot 1 of DNY Subdivision as recorded on Slide #1828-A in the office of the Judge of Probate of Baldwin County, Alabama described as follows:
Commence at an existing railroad spike marking the intersection of the former East right of way line of the L&N Railroad and the north right of way line of Sunflower Avenue in Section 33, Township 7 South, Range 4 East, Baldwin County, Alabama; thence South 89 degrees 54 minutes 26 seconds East along said North right of way line 200.90 feet to an iron rod marking the Point of Beginning; thence department said North right of way line North 00 degrees 28 minutes 12 seconds East along a line being 8.00 feet West and parallel to the East line of said Lot 1 for a distance of 150.00 feet to an iron rod set on the North Line of said Lot 1; Thence South 89 degrees 54 minutes 26 seconds East along the North line of said Lot 1 a distance of 8.00 feet to the Northeast corner of said Lot 1; Thence South 00 degrees 28 minutes 12 seconds West along the East line of said Lot 1 and the West side of an un-named street 150.00 feet to an iron rod marking the Southeast corner of said Lot 1; Thence North 89 degrees 54 minutes 26 seconds West, 8.00 feet to the Point of Beginning.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Foley, Alabama, in regular session April 20, 2015 does hereby accept the donation of an 8' stip of land along the rear boundary of Lot 1 of the Re-subdivision of Lot 1 of DNY Subdivision as recorded on Slide #1828-A in the Office of the Judge of Probate of Baldwin County, Alabama as described above. This Resolution shall become effective immediately upon its adoption as required by law.
